Please read first. This page summarizes the warranty terms for On Demand Pest
Control services and is provided for transparency and reference only. It is not an offer,
a contract, or a substitute for your service agreement. The warranty that applies to you is the one in the
agreement you sign for your specific service and property address. If anything on this page
differs from your signed agreement, your signed agreement controls. The terms in effect on
your signing date apply. Warranties are limited and subject to the conditions and exclusions stated below.

General Pest Control

General Household Pest Control (Monthly / Bi-Monthly / Quarterly / Commercial)

Limited Service Warranty

1Coverage

Subject to the terms below, On Demand Pest Control shall perform pest control services in and around the structures on the Purchaser's premises (the "Structure") for the control and mitigation of the pests identified on the front page of this Agreement as Indoor Covered Pests (the "Covered Pests"). On Demand Pest Control's obligation to control, mitigate, and re-service under this Agreement is limited to activity by a Covered Pest inside the Structure. Exterior treatment is performed as a preventive perimeter barrier to limit entry of Covered Pests into the Structure and does not constitute a guarantee against the presence of any pest outside the Structure or in detached areas of the premises. The Initial Service Visit shall apply pesticides to the interior of the Structure and to the exterior perimeter (the "Initial Treatment"). Subsequent regular service visits shall apply pesticides to the exterior perimeter only, on a recurring basis at intervals of approximately thirty (30) days for the duration of this Agreement. Interior treatment between regular visits is available, at no additional charge, upon Purchaser's request when activity by a Covered Pest is observed inside the Structure.

2Initial Term And Renewal

The initial term of this Agreement shall be a period of one (1) year beginning on the date executed (the "Initial Term"). Thereafter, this Agreement shall automatically renew on a month-to-month basis (each a "Renewal Term") unless earlier terminated in accordance with this Agreement. Cancellation; Buyout Option. Other than the three (3) business day right to cancel on the front page of this Agreement, Purchaser may not cancel during the Initial Term except by paying a Buyout Fee equal to fifty percent (50%) of the Recurring Service Charges remaining for the Initial Term (example: three remaining Recurring Service Charges of $100.00 each = $150.00 Buyout Fee). Any unpaid Initial Service Charge and past-due Recurring Service Charges remain owing. After the Initial Term, either party may terminate this Agreement upon thirty (30) days advance written notice.

3What Is Not Covered

This Agreement does not cover, and On Demand Pest Control has no obligation under this Agreement with respect to, any of the following:

  1. Excluded Pests. Termites (subterranean, drywood, and wood-boring beetles), bed bugs (Cimex lectularius), mosquitoes, wildlife, birds, and any pest not specifically listed as a Covered Pest on the front page of this Agreement. Excluded Pests, and pest activity occurring outside the Structure (including but not limited to detached buildings, mailbox areas, and landscaped areas of the premises) are available as separate services under separate agreements.
  2. Moisture and Structural Conditions. Conditions resulting from or contributed to by moisture (including water leakage from faulty plumbing, roofs, gutters, downspouts, poor drainage, or condensation) or by inherent structural problems (including wood-to-ground contact, masonry failures, grade alterations, or defective original construction).
  3. Damage Caused by Pests. On Demand Pest Control's role under this Agreement is limited solely to the control and mitigation of Covered Pests; this Agreement does not cover, and On Demand Pest Control shall not be liable for, any property damage caused by Covered Pests, Excluded Pests, or wood-destroying organisms — whether such damage occurred prior to, during, or after the term of this Agreement — including without limitation chewed materials, chewed wiring, damaged insulation, damaged ductwork, contaminated food, staining, droppings, odor, or structural repair.
  4. Conducive Conditions. Failure of the Purchaser to maintain the Structure or premises in a condition that does not promote pest activity, including without limitation excessive clutter, exposed food sources, standing water, harborage from overgrown vegetation, or unsealed entry points caused by third parties.
  5. Landscape and Underground Utilities. Damage to sod, walkways, driveways, or landscaping required to be crossed in the course of performing services; and damage to utilities or irrigation lines located underground that have not been identified and marked by the Purchaser prior to service.
  6. Acts of God. Pest re-infestation or damage resulting from hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.
  7. Eave and Roof Edge Access; Damage from Such Access. Purchaser acknowledges that, in the course of de-webbing eaves, fascia, soffits, gutters, and similar exterior surfaces using extension wands and, where necessary, ladders, technicians of On Demand Pest Control may walk on or otherwise access the roof edge, eaves, and adjacent areas of the Structure. Purchaser grants On Demand Pest Control such access and acknowledges that, no matter what degree of care is exercised, incidental damage to roof tiles, shingles, gutters, flashing, fascia, or similar exterior components may be unavoidable in the course of such access. Purchaser hereby releases On Demand Pest Control from any and all claims of damage to the roof or any of its components resulting from such access, whether or not such damage was foreseeable.

4Purchaser Responsibilities

As a condition of the services and any warranty under this Agreement: Purchaser must provide reasonable access to the Structure and premises for each scheduled service, including adding On Demand Pest Control to any gate or guardhouse list. If a technician is denied access or otherwise cannot reach the premises on a scheduled visit, a service fee of fifteen dollars ($15) may be added to the Purchaser's account. Purchaser must promptly notify On Demand Pest Control of any pest activity observed between scheduled visits. Purchaser must complete, within a reasonable time, any third-party repairs identified and recommended by On Demand Pest Control (including without limitation plumbing, roofing, or structural repairs that are conducive to pest activity). Failure to do so may void the warranty under Section 5 as to the affected areas. Purchaser must not interfere with bait stations, traps, or any other devices installed by On Demand Pest Control. Purchaser must promptly notify On Demand Pest Control of any change in service address, mailing address, payment method, or contact information.

5Warranty Service

Interim Service Visits. Between regularly scheduled visits, On Demand Pest Control shall, upon the Purchaser's request and at no additional charge, return to the premises to address ongoing activity by a Covered Pest. Interim Service Visits are subject to the limitations in Section 4 (Purchaser Responsibilities) and Section 3 (What Is Not Covered). 30-Day Satisfaction Guarantee. If, within thirty (30) days after the Initial Service Visit, the Purchaser is not satisfied with the services rendered, the Purchaser may notify On Demand Pest Control in writing of the specific concerns. If, after a written request from the Purchaser, On Demand Pest Control is unable to resolve those concerns to the Purchaser's reasonable satisfaction, On Demand Pest Control will refund the fees paid for the Initial Service and this Agreement shall terminate without further liability of either party. This is the Purchaser's sole and exclusive remedy for dissatisfaction with the Initial Service.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Agreement is to perform the pest control services described in Section 1 and to provide the warranty service described in Section 5. On Demand Pest Control's total liability under this Agreement shall not exceed the amount paid by the Purchaser to On Demand Pest Control during the twelve (12) months immediately preceding the event giving rise to the claim. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Rodent

Rodent Service Agreement

Limited Exclusion Plan Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants that the Exclusion System Components installed by On Demand Pest Control will perform as intended for the lifetime of the original Purchaser, at the original treated address only. Specifically: if rodents enter the Structure through an entry point that On Demand Pest Control identified and sealed as part of this Agreement and recorded on the Exclusion Form, On Demand Pest Control will re-seal that entry point at no additional charge.

2Not Transferable

This Warranty applies solely to the original Purchaser at the original treated address. It is not transferable. The Warranty terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Entry points not identified on the Exclusion Form. Any new entry point not originally identified and sealed by On Demand Pest Control — including without limitation entry points created by rodents chewing through wood, drywall, insulation, or other materials over time — is not covered. On Demand Pest Control will, upon request, inspect at no charge and quote any new exclusion work separately at standard rates.
  2. Plumbing. Entry points related to plumbing systems. On Demand Pest Control is not licensed for plumbing work.
  3. Roofing. Roofing repairs, including but not limited to roof underlayment, shingles, flashing, vents, soffits, fascia, or any other roofing system component. On Demand Pest Control is not licensed for roofing work.
  4. Roof Access; Damage from Roof Access. Purchaser acknowledges and agrees that On Demand Pest Control must walk on and otherwise access the roof of the Structure in order to perform the Services contemplated by this Agreement, and Purchaser grants On Demand Pest Control such access. Purchaser further acknowledges that, no matter what degree of care is exercised, damage to roof tiles, shingles, gutters, plumbing vents, flashing, or any other roofing system component may be unavoidable in the course of such access. Purchaser hereby releases On Demand Pest Control from any and all claims of damage to the roof or any of its components resulting from such access, whether or not such damage was foreseeable.
  5. Damage Caused by Rodents. Any damage caused by rodents themselves, including but not limited to chewed electrical wiring, damaged insulation, damaged ductwork, chewed furniture, contaminated food, or any other property damage.
  6. Dead Rodents Inside the Structure. Locating, accessing, or removing rodents that die inside walls, ceilings, attics, crawlspaces, or other inaccessible areas of the Structure.
  7. Trap Disturbance. Any failure of rodent traps caused by interference by non-target animals (including pets and wildlife) or by humans.
  8. Pre-Existing Decay or Damage. Any entry point through wood or other structural materials that are decayed, water-damaged, termite-damaged, or otherwise compromised at the time of service. Where such conditions exist, On Demand Pest Control will close off the area on a short-term basis and report the condition to the Purchaser. The Purchaser is responsible for arranging proper repair by a qualified third party. Failure to complete the recommended repairs within a reasonable time voids this Warranty as to the affected area.
  9. Acts of God. Damage to or failure of the Exclusion System Components caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.
  10. Third-Party Alteration. Any alteration of the Exclusion System Components or the Structures by parties other than On Demand Pest Control, including but not limited to new roof installation, HVAC additions or modifications, electrical penetrations, solar panel installation, or any other contractor work. The Purchaser must notify On Demand Pest Control in writing within ten (10) days of any such alterations; failure to do so voids this Warranty as to the affected areas.
  11. Garage Doors and Roll-Up Doors. On Demand Pest Control does not seal, repair, or rodent-proof garage doors or roll-up doors.
  12. Doors, Windows, and Pet Doors. On Demand Pest Control does not seal, repair, or rodent-proof exterior doors, windows, pet doors, or any door or window components.

4Purchaser Responsibilities

As a condition of this Warranty: Purchaser must promptly notify On Demand Pest Control of any rodent activity or signs of activity within the Structure. Purchaser must provide reasonable access to the Structure for inspection and any necessary re-work. Purchaser must complete, within a reasonable time, any third-party repairs identified and recommended by On Demand Pest Control (including but not limited to plumbing, roofing, or structural repairs). Failure to do so voids the Warranty as to the affected areas. Purchaser must not tamper with, remove, or alter the installed Exclusion System Components.

5Warranty Service

This Warranty is provided on a reactive basis. On Demand Pest Control does not perform scheduled or proactive annual inspections. Upon Purchaser's notice of rodent activity or concern, On Demand Pest Control will schedule an inspection at no charge. If the inspection determines that a covered entry point has failed, On Demand Pest Control will re-seal that point at no additional charge. If the inspection determines the issue is not covered under this Warranty (for example, a new entry point or any condition listed in Section 3 above), On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is to re-seal covered entry points as set forth in Section 1. On Demand Pest Control's total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Rodent Exclusion service under this Agreement. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Rodent Monitoring Service

Limited Monitoring Service Warranty

1Coverage

Subject to the terms below, On Demand Pest Control will perform the Rodent Bait Station Install and the Rodent Bait Station Monitoring Service described on the front page of this Agreement at the original treated address. The Service consists of: (a) one-time installation of code-compliant, tamper-resistant rodent bait stations along the perimeter of the Structure, loaded with rodenticide blocks, with the stations becoming the property of the Purchaser at the time of install; and (b) recurring on-site visits at the service interval selected on the front page, during which On Demand Pest Control will inspect each station for activity, replace consumed or degraded bait, clear debris from station entryways, and verify that stations remain properly placed and secured. The objective of the Service is to reduce rodent pressure around the perimeter of the Structure.

2Not A Guarantee Of Rodent-Free Premises

THIS SERVICE IS A POPULATION-REDUCTION TOOL ONLY. IT IS NOT A GUARANTEE THAT RODENTS WILL NOT BE PRESENT ON THE PROPERTY, INSIDE THE STRUCTURE, OR IN ANY PORTION OF THE STRUCTURE (INCLUDING BUT NOT LIMITED TO ATTICS, WALLS, CEILINGS, CRAWL SPACES, GARAGES, AND DUCTWORK). THIS SERVICE DOES NOT INCLUDE TRAPPING, EXCLUSION (SEALING ENTRY POINTS), INTERIOR TREATMENT, DEAD-RODENT RECOVERY, OR RODENT REMOVAL OF ANY KIND, AND DOES NOT COVER DAMAGE OF ANY KIND CAUSED BY RODENTS. If rodents enter the Structure or if active interior infestation is observed, the Purchaser should arrange a separate Rodent Service Agreement (removal and exclusion) at standard rates; this Monitoring Agreement is not an exclusion or removal contract and provides no warranty against rodent entry.

3What Is Not Covered

This Agreement does not cover, and On Demand Pest Control has no obligation under this Agreement with respect to, any of the following:

  1. Rodent Entry into the Structure. Rodents entering, nesting, or being present inside any portion of the Structure — including attics, walls, ceilings, soffits, crawl spaces, garages, basements, ductwork, HVAC systems, plumbing or electrical chases, or any interior space. This Service covers the exterior perimeter only.
  2. Damage Caused by Rodents. Any damage caused by rodents, including without limitation chewed wiring, damaged or chewed ductwork, damaged insulation, chewed plumbing, structural damage, contaminated food or stored items, droppings, urine staining, odors, and any other direct, indirect, or consequential property damage.
  3. Trapping, Exclusion, and Interior Treatment. Trapping, sealing of entry points, interior bait placement, dead-rodent location or removal, and any rodent- control activity not expressly described in Section 1. These may be quoted separately under a Rodent Service Agreement.
  4. Continued Presence of Rodents on the Property. The presence, sighting, or activity of rodents on the property, in the yard, in landscaping, in outbuildings, or anywhere outside the bait stations themselves. This Service reduces rodent pressure; it does not eliminate rodents from the environment.
  5. Pre-Existing or Active Interior Infestation. Rodent activity already established inside the Structure at the time of install or arising during the term. The Service is preventative perimeter pressure-reduction and is not designed or warranted to resolve active interior infestations.
  6. Mishandled, Disturbed, or Tampered Stations; Bait Displacement; Non-Target Ingestion. ON DEMAND PEST CONTROL IS NOT RESPONSIBLE FOR ANY CONSEQUENCE ARISING FROM A BAIT STATION BEING STRUCK, KICKED, MOVED, OPENED, RUN OVER, TAMPERED WITH, OR OTHERWISE DISTURBED BY ANY PERSON OR THING OTHER THAN AN ON DEMAND PEST CONTROL TECHNICIAN — including without limitation lawn-care, landscaping, pool-service, or other contractors, utility workers, the Purchaser, the Purchaser's family, guests, children, pets, or wild or non-target animals. This expressly includes any situation in which a bait block is dislodged from a station and is ingested by, or otherwise harms, a pet, child, wild animal, or any non- target animal or person. The Purchaser acknowledges that the stations are tamper-resistant only while undisturbed and properly seated, assumes all risk of bait displacement caused by disturbance, and agrees to instruct all third-party contractors and household members not to disturb the stations.
  7. Missing, Stolen, or Damaged-Beyond-Repair Stations. On Demand Pest Control will field-repair stations where reasonably practical. Stations that are missing, stolen, unaccounted for, or damaged beyond field repair shall be replaced at standard replacement cost, billed to the Purchaser.
  8. Access Limitations. Any station that cannot be safely or reasonably accessed on a given visit (landscape overgrowth, locked gates, parked vehicles, unrestrained animals, standing water, etc.) will not be serviced on that visit. The recurring charge remains due in full; the missed station is serviced on the next visit at which access is restored.
  9. Acts of God. Damage to, dislodgement of, or loss of stations caused by hurricanes, tropical storms, flooding, fire, earthquake, or other acts of God. Replacement at standard cost.
  10. Rodenticide Use. Staining, residue, odor, or any other condition associated with rodenticide use in or around the station, including in the event a rodent dies in a location where it cannot be reached or recovered.

4Purchaser Responsibilities

As a condition of this Agreement: Purchaser shall not move, relocate, cover, open, or tamper with any installed bait station, and shall not allow any household member or third party to do so. Purchaser shall instruct all third-party contractors who work on or around the property — including without limitation lawn-care, landscaping, pool-service, irrigation, fence, and pest-control contractors — that the stations are not to be moved, struck, opened, or otherwise disturbed. Purchaser shall provide reasonable access to all installed stations on the scheduled service interval, including clear pathways, unlocked gates where applicable, and reasonable restraint of pets at the time of service. Purchaser shall promptly notify On Demand Pest Control of any rodent activity inside the Structure or any damaged, dislodged, or missing station, and shall reimburse On Demand Pest Control for the replacement cost of any missing, stolen, or damaged-beyond-repair station. Purchaser shall keep current payment information on file and pay all recurring and one-time charges when due.

5Service Cadence

Scheduled service visits will occur monthly (every 30 days) from the install date for the duration of this Agreement. Between scheduled visits, the Purchaser may request a courtesy station inspection if heightened rodent activity is observed at the perimeter; such courtesy inspections do not extend the term, change the recurring billing schedule, or constitute interior treatment under any circumstance. Recurring service charges are billed on the same interval as the service visits and are due whether or not rodent activity is observed at any given visit, as the Service includes bait replacement and station maintenance regardless of activity level.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Agreement is to perform the Rodent Bait Station Install and the recurring Rodent Bait Station Monitoring Service as described in Sections 1 and 5. ON DEMAND PEST CONTROL'S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE PURCHASER FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, AND ON DEMAND PEST CONTROL SHALL HAVE NO LIABILITY FOR ANY DAMAGE TO PROPERTY, DAMAGE TO OR CONTAMINATION OF THE STRUCTURE OR ITS CONTENTS, DAMAGE CAUSED BY RODENTS OR RODENTICIDE, OR INJURY TO ANY PET, WILD ANIMAL, OR NON-TARGET ANIMAL ARISING FROM DISTURBANCE OF A STATION BY ANYONE OTHER THAN AN ON DEMAND PEST CONTROL TECHNICIAN. Additional disclaimers are set forth in Section 15.

Termite

Termite Bond (Drywood) — 1 Year

Limited Drywood Termite Bond Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants that the Drywood Termite Bond service performed under this Agreement — comprising one or more of Attic Treatment, Spot Injections, or Radius Treatment as designated on the first page — will, when applied in accordance with the manufacturer's specifications for the EPA-registered termiticide(s) used, control active drywood termite activity within the structural members identified during inspection as of the date of treatment. During the term of this Agreement, any additional drywood termite treatments deemed necessary by On Demand Pest Control will be provided at no additional charge. Reinspections will be performed only upon Purchaser request. Initial Term and Renewal. The initial term shall be one (1) year from the date of treatment (the "Initial Term"). Purchaser may extend the Agreement for additional one-year Renewal Terms by paying the Annual Renewable Warranty fee set forth on the first page prior to expiration of the Initial Term or any Renewal Term. On Demand Pest Control may revise the Annual Renewable Warranty fee for any subsequent Renewal Term upon thirty (30) days written notice. Failure to timely renew terminates this Agreement; reinstatement may require a fresh inspection and additional treatment at Purchaser's expense. This Agreement does not guarantee, and On Demand Pest Control does not represent, that drywood termites or other pests will not return.

2Transferable With Written Notice

This Agreement is transferable to a new owner of the original treated property upon written notice to On Demand Pest Control within thirty (30) days of closing. Transfer is for the remainder of the Initial Term or current Renewal Term only and does not reset the term. No transfer fee applies if notice is timely. After the thirty (30) day notice period, transfer is subject to the sole discretion of On Demand Pest Control and may require a re-inspection at the requesting party's expense.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Wood Repairs. Damage caused by any wood-destroying organism existing in the past, present, or future is not covered. On Demand Pest Control will not perform, pay for, or be responsible for wood repair or replacement of any kind, including structural lumber, framing, sheathing, sub-flooring, trim, doors, windows, or cabinetry.
  2. Non-Drywood Organisms. Subterranean termites (Reticulitermes spp., Heterotermes spp.), Formosan termites (Coptotermes spp.), dampwood termites, wood-destroying beetles, carpenter ants, fungi, and any other wood-destroying pest or organism.
  3. Re-Infestation. If the Structure is re-infested by drywood termites or any wood-destroying organism after treatment, On Demand Pest Control's sole obligation is re-treatment under Section 5. No wood damage caused by such re-infestation — past, present, or future — is covered at any time.
  4. Attic and Roof Access; Pre-Existing Structural Conditions. Performance of the Bond service requires On Demand Pest Control technicians to walk on and otherwise access attic spaces and, in limited cases, related roof access points. The Purchaser grants On Demand Pest Control such access. On Demand Pest Control is not liable for damage to attic structural members, finished ceilings, drywall, insulation, roof decking, or other property caused or contributed to by pre-existing conditions, including but not limited to: termite-damaged or compromised joists, rafters, trusses, decking, or framing; water-damaged, rotted, or moisture-affected framing; framing affected by prior leaks or moisture intrusion; defective original construction; undersized, mis-spaced, or improperly installed structural members; concealed prior repairs; and any other latent defect. Ordinary, non-negligent access marks — including displaced insulation, dust, footprints, and minor stress at attic-hatch perimeters — are inherent to the work and are not covered. This Section 3(d) is the negotiated allocation of risk for service performed in spaces On Demand Pest Control did not construct, maintain, or previously inspect, and is supported by the Purchaser's separate initials on the first page.
  5. Structural Modifications. Any alteration of the Structure(s) after treatment — including additions, structural modifications, roof replacement, HVAC additions, soil regrading, or solar panel installation — voids this Warranty as to the affected areas unless Purchaser notifies On Demand Pest Control in writing within ten (10) days and arranges for re-inspection or additional treatment at Purchaser's expense.
  6. Moisture and Water Damage. Any moisture-related condition, including fungus, water leakage from faulty plumbing, roof leaks, gutters, downspouts, or poor drainage. Purchaser is responsible for timely repairs to stop water leakage identified by On Demand Pest Control. Failure to do so terminates this Warranty as to the affected areas.
  7. Other Pre-Existing Conditions. Pre-existing wood decay, masonry failure, inherent structural problems, or wood-to-ground contact existing at the time of service, to the extent not addressed by Section 3(d) above.
  8. Areas Denied or Inaccessible. Drywood termite activity in structural members or areas that the Purchaser denies access to, that are physically inaccessible, or that were not identified for treatment on the first page of this Agreement.
  9. Acts of God. Damage to the Structure or failure of treatment caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.

4Purchaser Responsibilities

As a condition of this Warranty, Purchaser must:

  1. Provide On Demand Pest Control with reasonable access to the Structure, attic spaces, and any other areas designated for treatment or warranty inspection.
  2. Promptly notify On Demand Pest Control of any signs of drywood termite activity within the Structure during the term of this Agreement.
  3. Notify On Demand Pest Control in writing within ten (10) days of any structural alteration, addition, or modification to the Structure(s) as described in Section 3(e).
  4. At Purchaser's expense, repair or remediate any pre-existing structural condition identified by On Demand Pest Control that affects the safety of attic or other access, the effectiveness of treatment, or the integrity of the Structure.
  5. Make timely repairs to stop water leakage identified by On Demand Pest Control, as described in Section 3(f).

5Warranty Service

This Warranty is provided on a reactive basis. On Demand Pest Control does not perform scheduled or proactive annual reinspections. Upon Purchaser's notice of drywood termite activity, On Demand Pest Control will schedule an inspection at no charge. If the inspection determines that the activity is covered under this Warranty, On Demand Pest Control will re-treat at no additional charge. If the inspection determines the activity is not covered (for example, any condition listed in Section 3 above), On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is re-treatment as set forth in Section 5. Total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Drywood Termite Bond service. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Termite Bond (Drywood) — 3 Year

Limited Drywood Termite Bond Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants that the Drywood Termite Bond service performed under this Agreement — comprising one or more of Attic Treatment, Spot Injections, or Radius Treatment as designated on the first page — will, when applied in accordance with the manufacturer's specifications for the EPA-registered termiticide(s) used, control active drywood termite activity within the structural members identified during inspection as of the date of treatment. During the term of this Agreement, any additional drywood termite treatments deemed necessary by On Demand Pest Control will be provided at no additional charge. Reinspections will be performed only upon Purchaser request. Initial Term and Renewal. The initial term shall be three (3) years from the date of treatment (the "Initial Term"). After the Initial Term expires, Purchaser may extend the Agreement for additional one-year Renewal Terms by paying the Annual Renewable Warranty fee set forth on the first page prior to expiration of the Initial Term or any Renewal Term. On Demand Pest Control may revise the Annual Renewable Warranty fee for any Renewal Term upon thirty (30) days written notice. Failure to timely renew terminates this Agreement; reinstatement may require a fresh inspection and additional treatment at Purchaser's expense. This Agreement does not guarantee, and On Demand Pest Control does not represent, that drywood termites or other pests will not return.

2Transferable With Written Notice

This Agreement is transferable to a new owner of the original treated property upon written notice to On Demand Pest Control within thirty (30) days of closing. Transfer is for the remainder of the Initial Term or current Renewal Term only and does not reset the term. No transfer fee applies if notice is timely. After the thirty (30) day notice period, transfer is subject to the sole discretion of On Demand Pest Control and may require a re-inspection at the requesting party's expense.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Wood Repairs. Damage caused by any wood-destroying organism existing in the past, present, or future is not covered. On Demand Pest Control will not perform, pay for, or be responsible for wood repair or replacement of any kind, including structural lumber, framing, sheathing, sub-flooring, trim, doors, windows, or cabinetry.
  2. Non-Drywood Organisms. Subterranean termites (Reticulitermes spp., Heterotermes spp.), Formosan termites (Coptotermes spp.), dampwood termites, wood-destroying beetles, carpenter ants, fungi, and any other wood-destroying pest or organism.
  3. Re-Infestation. If the Structure is re-infested by drywood termites or any wood-destroying organism after treatment, On Demand Pest Control's sole obligation is re-treatment under Section 5. No wood damage caused by such re-infestation — past, present, or future — is covered at any time.
  4. Attic and Roof Access; Pre-Existing Structural Conditions. Performance of the Bond service requires On Demand Pest Control technicians to walk on and otherwise access attic spaces and, in limited cases, related roof access points. The Purchaser grants On Demand Pest Control such access. On Demand Pest Control is not liable for damage to attic structural members, finished ceilings, drywall, insulation, roof decking, or other property caused or contributed to by pre-existing conditions, including but not limited to: termite-damaged or compromised joists, rafters, trusses, decking, or framing; water-damaged, rotted, or moisture-affected framing; framing affected by prior leaks or moisture intrusion; defective original construction; undersized, mis-spaced, or improperly installed structural members; concealed prior repairs; and any other latent defect. Ordinary, non-negligent access marks — including displaced insulation, dust, footprints, and minor stress at attic-hatch perimeters — are inherent to the work and are not covered. This Section 3(d) is the negotiated allocation of risk for service performed in spaces On Demand Pest Control did not construct, maintain, or previously inspect, and is supported by the Purchaser's separate initials on the first page.
  5. Structural Modifications. Any alteration of the Structure(s) after treatment — including additions, structural modifications, roof replacement, HVAC additions, soil regrading, or solar panel installation — voids this Warranty as to the affected areas unless Purchaser notifies On Demand Pest Control in writing within ten (10) days and arranges for re-inspection or additional treatment at Purchaser's expense.
  6. Moisture and Water Damage. Any moisture-related condition, including fungus, water leakage from faulty plumbing, roof leaks, gutters, downspouts, or poor drainage. Purchaser is responsible for timely repairs to stop water leakage identified by On Demand Pest Control. Failure to do so terminates this Warranty as to the affected areas.
  7. Other Pre-Existing Conditions. Pre-existing wood decay, masonry failure, inherent structural problems, or wood-to-ground contact existing at the time of service, to the extent not addressed by Section 3(d) above.
  8. Areas Denied or Inaccessible. Drywood termite activity in structural members or areas that the Purchaser denies access to, that are physically inaccessible, or that were not identified for treatment on the first page of this Agreement.
  9. Acts of God. Damage to the Structure or failure of treatment caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.

4Purchaser Responsibilities

As a condition of this Warranty, Purchaser must:

  1. Provide On Demand Pest Control with reasonable access to the Structure, attic spaces, and any other areas designated for treatment or warranty inspection.
  2. Promptly notify On Demand Pest Control of any signs of drywood termite activity within the Structure during the term of this Agreement.
  3. Notify On Demand Pest Control in writing within ten (10) days of any structural alteration, addition, or modification to the Structure(s) as described in Section 3(e).
  4. At Purchaser's expense, repair or remediate any pre-existing structural condition identified by On Demand Pest Control that affects the safety of attic or other access, the effectiveness of treatment, or the integrity of the Structure.
  5. Make timely repairs to stop water leakage identified by On Demand Pest Control, as described in Section 3(f).

5Warranty Service

This Warranty is provided on a reactive basis. On Demand Pest Control does not perform scheduled or proactive annual reinspections. Upon Purchaser's notice of drywood termite activity, On Demand Pest Control will schedule an inspection at no charge. If the inspection determines that the activity is covered under this Warranty, On Demand Pest Control will re-treat at no additional charge. If the inspection determines the activity is not covered (for example, any condition listed in Section 3 above), On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is re-treatment as set forth in Section 5. Total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Drywood Termite Bond service. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Termite Baiting System

Limited Termite Baiting Warranty

1Coverage

Subject to the terms below, On Demand Pest Control will install the Premium Termite Baiting System (the "Baiting System") at the structure(s) identified on the front page of this Agreement (the "Structure") as a one-time service. The first year of monitoring (the "Initial Term") is included with installation and runs for twelve (12) months from the installation date. Thereafter, the Purchaser may, at the Purchaser's option, renew this Agreement for additional one-year Renewal Terms by paying the annual Warranty Renewal fee in advance of each Renewal Term, so long as the Purchaser owns the Structure. The Optional Annual Warranty Renewal is not required; if the Purchaser elects not to renew, this Agreement expires at the end of the Initial Term or the then-current Renewal Term, and the Baiting System remains in the ground until removed (with no further monitoring or servicing obligation by On Demand Pest Control). During the Initial Term and any elected Renewal Term, On Demand Pest Control will inspect the installed Baiting System on at least an annual basis and will, as deemed necessary in its professional judgment, replace, refresh, or repair stations and bait at no additional charge in order to provide ongoing prevention, control, and/or elimination of subterranean termite colonies. THIS AGREEMENT PROVIDES FOR INSTALLATION, MONITORING, AND SERVICING OF THE BAITING SYSTEM ONLY; IT DOES NOT PROVIDE FOR THE REPAIR OR REPLACEMENT OF ANY DAMAGE CAUSED BY TERMITES.

2Scope And Transfer

This Warranty covers SUBTERRANEAN TERMITES ONLY — specifically Eastern Subterranean termites (Reticulitermes spp., Heterotermes spp.) and Formosan termites (Coptotermes spp.). The Baiting System does not control or protect the Structure from drywood termites (Kalotermes spp., Incisitermes spp., Cryptotermes spp.), aerial (above-ground) infestations of any kind, or other wood-destroying organisms including carpenter ants, powder-post beetles, or wood-decay fungi. Fumigation or spot termiticide treatment may be required to address aerial or drywood infestations; such treatment is not covered and is available under a separate agreement at On Demand Pest Control's then-current rates. This Warranty is transferable to a subsequent owner of the Structure. Upon any sale or transfer of ownership, the new owner must provide written notice of the change of ownership to On Demand Pest Control within thirty (30) days of the transfer in order to continue this Warranty on its existing terms; On Demand Pest Control may, at its option, perform a courtesy re-inspection of the installed Baiting System to confirm its condition. If written notice is not received within thirty (30) days of the change of ownership, this Warranty terminates automatically as of the date of transfer.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Damage Caused by Termites. Any damage to the Structure, its contents, or any other property caused by termites of any species, whether occurring before, during, or after the term of this Agreement. THIS AGREEMENT IS A NO-WOOD-REPAIR CONTRACT. No repair, replacement, or reimbursement for termite damage is included.
  2. Non-Subterranean Species. Drywood termites, dampwood termites, and any other species of termite not within the Subterranean Termites category. Aerial (above- ground) infestations of any kind. Other wood-destroying organisms including carpenter ants, powder-post beetles, and wood-decay fungi.
  3. Installation Disturbance and Access. Installing bait stations is an invasive procedure that involves drilling and digging in the soil around the Structure's perimeter, with disturbance of sod, hardscape, and adjacent fixtures. The Purchaser grants On Demand Pest Control access to the perimeter and surrounding soil and acknowledges that some damage to landscaping, irrigation, low-voltage wiring, pipes, electrical lines, or paint may be unavoidable. Limited roof access may be required for inspection; the Purchaser grants such roof access and hereby releases On Demand Pest Control from any and all claims of damage to the roof or any of its components, and from any unforeseen damages incidental to installation.
  4. Removed, Disturbed, or Tampered Stations. Any portion of the Baiting System that is removed, disturbed, paved over, buried, dug up, or otherwise tampered with by anyone other than On Demand Pest Control, including without limitation by landscapers, contractors, utility workers, or the Purchaser. Removal of bait stations may result in a lack of termite protection.
  5. Structural Additions and Alterations. Any addition, renovation, or alteration to the Structure (including changes to footprint, grade, soil added or removed around the foundation, or any condition that alters the perimeter on which the Baiting System depends) of which On Demand Pest Control was not notified in writing within ten (10) days of the change. Failure to notify voids this Warranty as to the affected areas.
  6. Conducive Conditions. Any infestation or re-infestation arising from conditions conducive to termite activity that On Demand Pest Control identifies in writing and the Purchaser fails to correct within a reasonable time, including without limitation wood-to-ground contact, untreated cellulose debris adjacent to the Structure, and chronic moisture sources.
  7. Water Leakage and Moisture. Damage or warranty failure attributable in whole or in part to water leakage through the roof, exterior walls, or interior plumbing, or to faulty drainage, gutters, or downspouts. The Purchaser is responsible for making timely repairs to stop water leakage identified by On Demand Pest Control; failure to do so terminates this Agreement automatically.
  8. Pre-Existing Infestation or Damage. Any termite infestation or damage existing at the time of installation, whether visible or concealed. Pre-existing conditions are documented at installation; any pre-existing damage discovered later is treated as not covered.
  9. Acts of God. Damage to or failure of the Baiting System caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.

4Purchaser Responsibilities

As a condition of this Warranty: Purchaser must allow On Demand Pest Control reasonable access to the Structure and surrounding soil for installation, inspection, monitoring, and service. Denial of access terminates this Agreement automatically. Purchaser must promptly notify On Demand Pest Control in writing of (a) any termite activity or signs of activity observed in or around the Structure, (b) any structural additions or alterations to the Structure within ten (10) days of the change, and (c) any disturbance, damage to, or relocation of installed bait stations. Purchaser must complete, within a reasonable time, any repairs identified in writing by On Demand Pest Control (including but not limited to plumbing, roofing, drainage, or moisture remediation) that are conducive to termite activity or that impair the effectiveness of the Baiting System. Failure to do so voids this Warranty as to the affected areas and may, where the condition is fundamental, terminate this Agreement. Purchaser must not tamper with, remove, pave over, or otherwise alter the installed bait stations or the Baiting System. Purchaser must pay the Warranty Renewal fee in advance of each Renewal Term to maintain continuous coverage.

5Warranty Service

In addition to the annual inspection described in Section 1, during the Initial Term and any elected Renewal Term the Purchaser may request an additional service visit at no charge upon observing termite activity or station disturbance, and On Demand Pest Control will respond within a commercially reasonable time. If, after twenty-four (24) months of continuous coverage from the date of installation, subterranean termite colony control or elimination has not been achieved at the Structure, On Demand Pest Control may, in its sole discretion, propose conventional liquid termiticide treatment at no additional charge. If the Purchaser accepts the proposal, a new written contract in the form then in use by On Demand Pest Control will be executed before such treatment; due to the nature of conventional treatment, the new contract may not provide any damage-repair commitment. If the Purchaser declines, this Agreement terminates without further obligation of On Demand Pest Control. Spot applications of conventional termiticides for localized aerial activity are available at On Demand Pest Control's then-current rates and are not required for colony elimination or control by the Baiting System. The twenty-four (24) month alternative-treatment option is available only if the Purchaser has maintained continuous coverage by electing each available Optional Annual Warranty Renewal; a lapsed renewal voids this option.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is to install, monitor, and service the Baiting System as set forth in Sections 1 and 5, and (where applicable under Section 5) to propose alternative conventional treatment after twenty-four (24) months without colony control. On Demand Pest Control's total liability under this Warranty shall not exceed the total amount paid by the Purchaser under this Agreement during the twelve (12) months immediately preceding the claim. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, LOSS OF ENJOYMENT, OR DIMINUTION IN VALUE OF THE STRUCTURE.

SPOT Drywood Termite Treatment

Limited Drywood Spot Treatment Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants that the Drywood Termite Spot Treatment performed under this Agreement, when applied in accordance with the manufacturer's specifications for the termiticide(s) used, will eliminate active drywood termite activity in the exact area(s) specified on the first page as of the date of treatment. Warranty Term. This Warranty covers the specified area(s) for a period of sixty (60) days from the date of treatment (the "Warranty Period"). During the Warranty Period, any additional drywood termite treatment deemed necessary by On Demand Pest Control within the specified area(s) will be provided at no additional charge. This Warranty is not renewable; upon expiration, no further coverage applies. Areas Outside the Specified Area(s). Drywood termite activity discovered in any area of the Structure that is not specifically identified on the first page, whether during the Warranty Period or thereafter, is not covered under this Agreement. Such activity, if treatment is requested, will be quoted and performed at additional cost to the Purchaser. On Demand Pest Control will not perform automatic or scheduled reinspections. Reinspection is provided only upon Purchaser request and may be subject to a service fee. This Agreement does not guarantee, and On Demand Pest Control does not represent, that drywood termites or other pests will not return.

2Not Transferable

This Agreement and the Limited Drywood Spot Treatment Warranty are personal to the Purchaser named on the first page and are not transferable to any subsequent owner, tenant, or occupant of the treated property. Any change in ownership or occupancy of the property terminates this Warranty as of the date of such change, without further notice.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Wood Repairs. Damage caused by any wood-destroying organism existing in the past, present, or future is not covered. On Demand Pest Control will not perform, pay for, or be responsible for wood repair or replacement of any kind, including structural lumber, framing, sheathing, sub-flooring, trim, doors, windows, or cabinetry.

  5. Re-Infestation Within the Specified Area(s). If a treated area is re-infested by drywood termites during the Warranty Period, On Demand Pest Control's sole obligation is re-treatment of that area under Section 5. No wood damage caused by such re-infestation — past, present, or future — is covered at any time.
  6. Attic and Roof Access; Pre-Existing Structural Conditions. Where performance of this service requires On Demand Pest Control technicians to walk on and otherwise access attic spaces and, in limited cases, related roof access points, the Purchaser grants On Demand Pest Control such access. 4Purchaser Responsibilities

As a condition of this Warranty, Purchaser must:

  1. Provide On Demand Pest Control with reasonable access to the treated area(s) at the time of treatment and for any re-treatment under this Warranty during the Warranty Period.
  2. Promptly notify On Demand Pest Control in writing of any signs of drywood termite activity within the treated area(s) during the sixty (60) day Warranty Period. Activity reported after the Warranty Period expires is not covered, regardless of when it may have begun.
  3. Notify On Demand Pest Control in writing within ten (10) days of any structural alteration, addition, or modification to the Structure(s) as described in Section 3(g).
  4. Make timely repairs to stop any water leakage or moisture condition identified by On Demand Pest Control. Failure to do so terminates this Warranty as to the affected area(s) without further notice.
  5. Refrain from disturbing, sealing, covering, repainting, or otherwise altering the treated area(s) in any manner that would interfere with On Demand Pest Control's ability to inspect or re-treat under this Warranty.

5Warranty Service

This Warranty is provided on a reactive basis during the sixty (60) day Warranty Period. On Demand Pest Control does not perform scheduled or proactive reinspections. Upon Purchaser's timely notice of drywood termite activity within a specified treated area, On Demand Pest Control will schedule an inspection at no charge. If the inspection determines that the activity is covered under this Warranty, On Demand Pest Control will re-treat the affected area at no additional charge. If the inspection determines the activity is not covered (including any condition listed in Section 3 above, activity outside the specified area(s), or activity reported after the Warranty Period), On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is re-treatment as set forth in Section 5. Total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Drywood Termite Spot Treatment service. Fumigation — Drywood Termite

Limited Drywood Fumigation Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants that the Drywood Termite Fumigation service performed under this Agreement will, when performed in accordance with the manufacturer's specifications for sulfuryl fluoride, eliminate active drywood termite infestations within the Structure(s) described on the first page as of the date of treatment. During the term of this Agreement, any additional drywood termite treatments deemed necessary by On Demand Pest Control will be provided at no additional charge. Reinspections will be performed only upon Purchaser request. Initial Term and Renewal. The initial term shall be one (1) year from the date of fumigation (the "Initial Term"). Purchaser may extend the Agreement for additional one-year Renewal Terms by paying the Annual Renewable Warranty fee set forth on the first page prior to expiration of the Initial Term or any Renewal Term. On Demand Pest Control may revise the Annual Renewable Warranty fee for any subsequent Renewal Term upon thirty (30) days written notice. This Agreement does not guarantee, and On Demand Pest Control does not represent, that drywood termites or other pests will not return.

2Transferable With Written Notice

This Agreement is transferable to a new owner of the original treated property upon written notice to On Demand Pest Control within thirty (30) days of closing. Transfer is for the remainder of the Initial Term or current Renewal Term only and does not reset the term. No transfer fee applies if notice is timely. After the thirty (30) day notice period, transfer is subject to the sole discretion of On Demand Pest Control and may require a re-inspection at the requesting party's expense.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Wood Repairs. Damage caused by any wood-destroying organism existing in the past, present, or future is not covered. On Demand Pest Control will not perform, pay for, or be responsible for wood repair or replacement of any kind, including structural lumber, framing, sheathing, sub-flooring, trim, doors, windows, or cabinetry.
  2. Non-Drywood Organisms. Subterranean termites (Reticulitermes spp., Heterotermes spp.), Formosan termites (Coptotermes spp.), dampwood termites, wood-destroying beetles, carpenter ants, fungi, and any other wood-destroying pest or organism.
  3. Re-Infestation. If the Structure is re-infested by drywood termites or any wood-destroying organism after fumigation, On Demand Pest Control's sole obligation is re-treatment under Section 7. No wood damage caused by such re-infestation — past, present, or future — is covered at any time.
  4. Damage Incidental to Fumigation. Damage to roofs, gutters, plants, screens, antennae, light fixtures, satellite dishes, solar panels, utility lines, paint, or other property arising from the fumigation process, tarp placement, sealing materials, or roof access, as described in the Disclaimer on the first page.
  5. Structural Modifications. Any alteration of the Structure(s) after fumigation — including additions, structural modifications, roof replacement, HVAC additions, soil regrading, or solar panel installation — voids this Warranty as to the affected areas unless Purchaser notifies On Demand Pest Control in writing within ten (10) days and arranges for re-inspection or additional treatment at Purchaser's expense.
  6. Moisture and Water Damage. Any moisture-related condition, including fungus, water leakage from faulty plumbing, roof leaks, gutters, downspouts, or poor drainage. Purchaser is responsible for timely repairs to stop water leakage identified by On Demand Pest Control. Failure to do so terminates this Warranty as to the affected areas.
  7. Pre-Existing Conditions. Pre-existing wood decay, water-damaged or termite-damaged wood, masonry failure, inherent structural problems, or wood-to- ground contact existing at the time of service.
  8. Acts of God. Damage to the Structure or failure of treatment caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.

4Purchaser Responsibilities

As a condition of this Warranty, Purchaser must:

  1. Complete all preparation work set forth in the Fumigation Preparation Checklist, which is incorporated into this Agreement by reference. Purchaser acknowledges that failure to complete required preparation may result in cancellation of the service, a $300 cancellation fee, and other charges as described in the Checklist.
  2. Vacate the Structure for the full Vacate Period set forth in Section 5 and not re-enter the Structure until clearance is posted by the licensed fumigator.
  3. Provide On Demand Pest Control with key access, secondary lock access, and reasonable access to the Structure for performance of the fumigation and for any re-treatment under this Warranty.
  4. Notify On Demand Pest Control in writing within ten (10) days of any structural alteration, addition, or modification to the Structure(s) as described in Section 3(e).
  5. Promptly notify On Demand Pest Control of any signs of drywood termite activity within the Structure during the term of this Agreement.

5Vacate Period And Re-Entry

The typical Vacate Period is two (2) nights and three (3) days, with the Purchaser returning to the Structure by the end of the third day. The Vacate Period may be longer based on weather conditions (including but not limited to temperatures below 55°F or sustained winds exceeding 15–20 mph), foam-insulated attic spaces, the cubic footage and configuration of the Structure, or other unforeseen circumstances. Re-entry is permitted only after the licensed fumigator has tested clearance levels and posted a written clearance notice on the Structure. Under no circumstances shall Purchaser, household members, contractors, or any other person enter the Structure before clearance is posted.

6Rescheduling Fee

Once a fumigation date is reserved, a $300 rescheduling fee applies to any Purchaser-initiated change of date. This fee reflects costs incurred by On Demand Pest Control in connection with the reserved date, including state notifications, crew and equipment scheduling, and tarp logistics. The rescheduling fee is in addition to any cancellation fees described in the Fumigation Preparation Checklist.

Bed Bug

Bed Bug Liquid Treatment

Limited Bedbug Liquid Treatment Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants the Bedbug Liquid Treatment performed under this Agreement for a period of sixty (60) days from the date the final treatment visit under this Agreement is completed. Treatment under this Agreement consists of two visits scheduled approximately fourteen (14) days apart unless additional visits are specified in the Treatment notes on the front page of this Agreement. If live bedbug activity is confirmed by On Demand Pest Control within the originally treated areas during the warranty period, On Demand Pest Control will perform additional liquid re-treatment of the affected areas at no additional charge. This Warranty is limited to liquid re-treatment only; fumigation, heat treatment, or any other alternative treatment method is not included under this Warranty.

2Not Transferable

This Warranty applies solely to the original Purchaser at the original treated address. It is not transferable. The Warranty terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Re-Introduction From External Sources. Bedbug activity originating from any source outside the originally treated areas, including but not limited to luggage, clothing, bedding, used or second-hand furniture, items brought into the Structure after treatment, infested adjacent units, neighboring rooms not included in this Agreement, or pest entry from adjacent structures. Bedbugs are easily reintroduced from outside the treated areas and such reintroduction is not a failure of the treatment.
  2. Areas Not Included in the Treatment. Any room, unit, vehicle, storage area, or structure not listed on the front page of this Agreement and not treated by On Demand Pest Control. New areas may be treated under a separate quote at standard rates.
  3. Failure To Complete Preparation. Any reduction in treatment effectiveness resulting from the Purchaser's failure to complete the preparation instructions provided by On Demand Pest Control prior to each visit, including but not limited to laundering bedding, decluttering, providing access to mattresses and furniture, removing items from beds, or vacating treated areas until dry.
  4. Missed Follow-Up Visits. Any reduction in treatment effectiveness resulting from the Purchaser's failure to permit, schedule, or be present for the follow-up visit(s) within a reasonable window of the approximately fourteen (14) day interval required for control. Bedbug control requires the full sequence of visits specified in this Agreement; a single visit alone is not a complete treatment.
  5. Other Pests. This Warranty covers bedbugs (Cimex lectularius and Cimex hemipterus) only. Bites, marks, or activity attributed by the Purchaser to other pests, allergens, or unknown causes are not covered.
  6. Property Damage. Stains, discoloration, residue, or other damage to fabrics, mattresses, upholstery, paint, finishes, electronics, or other items resulting from the application of treatment products in accordance with label instructions. Liquid products are applied per label and are generally considered safe for the surfaces treated; nonetheless, the Purchaser accepts the risk of incidental cosmetic effects on porous, sensitive, or pre-damaged surfaces.
  7. Pre-Existing Damage and Infestation Severity. Conditions present at the time of service that materially affect treatment outcomes, including but not limited to severe infestations exceeding what a liquid treatment program can reasonably control, structural conditions providing harborage that cannot be reached by liquid application, or pre-existing damage that conceals bedbug populations. In such cases, On Demand Pest Control may recommend fumigation or another treatment method, which would be quoted separately and is not included under this Agreement.
  8. Health Effects. Any physical, allergic, psychological, or other health effect alleged to result from bedbug activity or from exposure to treatment products. Purchasers with known sensitivities, medical conditions, infants, pregnant occupants, or pets should disclose these to On Demand Pest Control before treatment.
  9. Acts of God. Damage to or interference with the treatment caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.
  10. Customer Modifications. Cleaning, painting, recarpeting, structural alteration, or pesticide application by parties other than On Demand Pest Control between the initial visit and the follow-up visit, where such activity interferes with the residual effectiveness of the applied products.

4Purchaser Responsibilities

As a condition of this Warranty: Purchaser must complete the preparation instructions provided by On Demand Pest Control before each treatment visit, including laundering bedding and clothing as directed, decluttering treated areas, and providing clear access to beds, furniture, and harborage points. Purchaser must vacate treated areas during application and until treated surfaces are dry (typically within two hours). Purchaser must permit and be available for all follow-up visits within a reasonable window of the approximately fourteen (14) day interval required for control. Purchaser must promptly notify On Demand Pest Control of any continued or renewed bedbug activity within the warranty period. Purchaser must not apply other pesticides, foggers, or treatments to the treated areas between visits without first consulting On Demand Pest Control, as these can disperse bedbugs and reduce treatment effectiveness. Purchaser must disclose any medical conditions, sensitivities, pets, infants, pregnant occupants, or other circumstances that may be relevant to product selection or application.

5Warranty Service

This Warranty is provided on a reactive basis. On Demand Pest Control does not perform scheduled or proactive inspections during the warranty period. Upon Purchaser's notice of continued or renewed bedbug activity within the warranty period, On Demand Pest Control will schedule an inspection at no charge. If the inspection confirms live bedbug activity in the originally treated areas and determines the activity is covered under this Warranty, On Demand Pest Control will perform additional liquid re-treatment at no additional charge. If the inspection determines the issue is not covered under this Warranty (for example, re-introduction from an external source or activity in areas not originally treated), On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is to perform liquid re-treatment of covered areas as set forth in Section 1. On Demand Pest Control's total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Bedbug Liquid Treatment service under this Agreement. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, LOSS OF ENJOYMENT, ALLEGED HEALTH EFFECTS, OR CLAIMS OF EMOTIONAL DISTRESS.

Fumigation — Bed Bug

Limited Bedbug Fumigation Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants that the Bedbug Fumigation service performed under this Agreement will, when performed in accordance with the manufacturer's specifications for sulfuryl fluoride at the dose required for bedbug elimination, eliminate active bedbug infestations within the Structure(s) described on the first page as of the date of treatment. During the warranty period defined below, any additional bedbug treatments deemed necessary by On Demand Pest Control will be provided at no additional charge. Reinspections will be performed only upon Purchaser request. Warranty Period. The warranty period shall be sixty (60) days from the date of fumigation. This Agreement does not provide renewal terms; if extended coverage is desired, Purchaser may schedule a follow-up fumigation under a new agreement at the then-current price. This Agreement does not guarantee that bedbugs or other pests will not return, particularly given that bedbugs are commonly reintroduced from sources outside the Structure.

2Not Transferable

This Agreement and the warranty granted hereunder are personal to the original Purchaser and the originally treated Structure(s). Given the brief sixty (60) day warranty period, this Agreement is not transferable to any new owner, tenant, or occupant. Any change of ownership or occupancy during the warranty period terminates the warranty as of the date of transfer.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Re-Infestation from External Sources. Bedbug activity introduced to the Structure after fumigation from any external source is not covered, including but not limited to: luggage, clothing, personal items, used or secondhand furniture or bedding, items brought in by guests or new occupants, and pest entry from adjacent units or outside the treated Structure.
  2. Non-Bedbug Pests. Any pest or organism other than bedbugs (Cimex lectularius, Cimex hemipterus), including but not limited to fleas, ticks, mites, cockroaches, ants, rodents, wood-destroying organisms, and other insects or arthropods.
  3. Multi-Unit Re-Introduction. Where the Structure is part of a multi-unit building (condominium, apartment, townhouse, or attached dwelling), bedbug activity originating from or re-introduced by adjacent or connected units is not covered. This Warranty extends only to the treated Structure.
  4. Damage Incidental to Fumigation. Damage to roofs, gutters, plants, screens, antennae, light fixtures, satellite dishes, solar panels, utility lines, paint, or other property arising from the fumigation process, tarp placement, sealing materials, or roof access, as described in the Disclaimer on the first page.
  5. Property Damage from Bedbug Activity. Stains, soiling, or damage to mattresses, bedding, upholstery, furniture, clothing, or other personal property caused by bedbugs — past, present, or future — is not covered. The Purchaser is solely responsible for cleaning, laundering, or replacement of any items affected by bedbug activity.
  6. Failure to Follow Re-Entry Procedures. Bedbug activity resulting from the Purchaser's failure to follow post-fumigation procedures recommended by On Demand Pest Control or the licensed fumigator, including laundering of bedding and clothing, vacuuming of mattresses and upholstery, and discarding of any items identified for removal.
  7. Pre-Existing Conditions. Pre-existing structural problems, inadequate sealing of the Structure that prevents effective fumigation, hoarding conditions, or any condition disclosed by On Demand Pest Control prior to service that the Purchaser declined to remedy.
  8. Acts of God. Failure of treatment or damage to the Structure caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.

4Purchaser Responsibilities

As a condition of this Warranty, Purchaser must:

  1. Complete all preparation work set forth in the Fumigation Preparation Checklist, which is incorporated into this Agreement by reference. Failure to follow these procedures may result in re-infestation that is not covered under this Warranty (see Section 3(f)).
  5. Promptly notify On Demand Pest Control of any signs of bedbug activity within the Structure during the warranty period.

Wildlife

Wildlife Service

Limited Exclusion Plan Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants that the Exclusion System Components installed by On Demand Pest Control will perform as intended for the lifetime of the original Purchaser, at the original treated address only. Specifically: if any Covered Wildlife enter the Structure through an entry point that On Demand Pest Control identified and sealed as part of this Agreement and recorded on the Exclusion Form, On Demand Pest Control will re-seal that entry point at no additional charge. For purposes of this Warranty, "Covered Wildlife" means raccoons, opossums, tree squirrels, flying squirrels, and iguanas.

2Not Transferable

This Warranty applies solely to the original Purchaser at the original treated address. It is not transferable. The Warranty terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Entry points not identified on the Exclusion Form. Any new entry point not originally identified and sealed by On Demand Pest Control — including without limitation entry points created by wildlife chewing, clawing, or otherwise breaching wood, drywall, insulation, soffits, or other materials over time — is not covered. On Demand Pest Control will, upon request, inspect at no charge and quote any new exclusion work separately at standard rates.
  2. Birds. Although On Demand Pest Control may perform exclusion work targeting birds at the Purchaser's request, this Warranty does not cover bird re-entry through any sealed point. Any bird-related follow-up work will be quoted separately at standard rates.
  3. Species outside Covered Wildlife. Bats, snakes, rodents (rats and mice), and any other species not listed as Covered Wildlife in Section 1 are not warranted under this Agreement, even if exclusion work incidentally affects entry points used by such species. Rodent exclusion is offered under a separate Rodent Service Agreement.
  4. Plumbing. Entry points related to plumbing systems. On Demand Pest Control is not licensed for plumbing work.
  5. Roofing. Roofing repairs, including but not limited to roof underlayment, shingles, flashing, vents, soffits, fascia, or any other roofing system component. On Demand Pest Control is not licensed for roofing work.
  6. Roof Access; Damage from Roof Access. Purchaser acknowledges and agrees that On Demand Pest Control must walk on and otherwise access the roof of the Structure in order to perform the Services contemplated by this Agreement, and Purchaser grants On Demand Pest Control such access. Purchaser further acknowledges that, no matter what degree of care is exercised, damage to roof tiles, shingles, gutters, plumbing vents, flashing, or any other roofing system component may be unavoidable in the course of such access. Purchaser hereby releases On Demand Pest Control from any and all claims of damage to the roof or any of its components resulting from such access, whether or not such damage was foreseeable.
  7. Damage Caused by Wildlife. Any damage caused by wildlife themselves, including but not limited to chewed electrical wiring, damaged or contaminated insulation, damaged ductwork, contaminated attics or crawlspaces, structural damage from raccoon or squirrel activity, droppings remediation, chewed furniture, contaminated food, or any other property damage.
  8. Dead Wildlife Inside the Structure. Locating, accessing, or removing wildlife that die inside walls, ceilings, attics, crawlspaces, or other inaccessible areas of the Structure.
  9. Trap Disturbance. Any failure of wildlife traps caused by interference by non-target animals (including pets and other wildlife) or by humans.
  10. Pre-Existing Decay or Damage. Any entry point through wood or other structural materials that are decayed, water-damaged, termite-damaged, or otherwise compromised at the time of service. Where such conditions exist, On Demand Pest Control will close off the area on a short-term basis and report the condition to the Purchaser. The Purchaser is responsible for arranging proper repair by a qualified third party. Failure to complete the recommended repairs within a reasonable time voids this Warranty as to the affected area.
  11. Acts of God. Damage to or failure of the Exclusion System Components caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.
  12. Third-Party Alteration. Any alteration of the Exclusion System Components or the Structures by parties other than On Demand Pest Control, including but not limited to new roof installation, HVAC additions or modifications, electrical penetrations, solar panel installation, or any other contractor work. The Purchaser must notify On Demand Pest Control in writing within ten (10) days of any such alterations; failure to do so voids this Warranty as to the affected areas.
  13. Garage Doors and Roll-Up Doors. On Demand Pest Control does not seal, repair, or wildlife-proof garage doors or roll-up doors.
  14. Doors, Windows, and Pet Doors. On Demand Pest Control does not seal, repair, or wildlife-proof exterior doors, windows, pet doors, or any door or window components.

4Purchaser Responsibilities

As a condition of this Warranty: Purchaser must promptly notify On Demand Pest Control of any wildlife activity or signs of activity within the Structure. Purchaser must provide reasonable access to the Structure for inspection and any necessary re-work. Purchaser must complete, within a reasonable time, any third-party repairs identified and recommended by On Demand Pest Control (including but not limited to plumbing, roofing, or structural repairs). Failure to do so voids the Warranty as to the affected areas. Purchaser must not tamper with, remove, or alter the installed Exclusion System Components.

5Warranty Service

This Warranty is provided on a reactive basis. On Demand Pest Control does not perform scheduled or proactive annual inspections. Upon Purchaser's notice of wildlife activity or concern, On Demand Pest Control will schedule an inspection at no charge. If the inspection determines that a covered entry point has failed, On Demand Pest Control will re-seal that point at no additional charge. If the inspection determines the issue is not covered under this Warranty (for example, a new entry point or any condition listed in Section 3 above), On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is to re-seal covered entry points as set forth in Section 1. On Demand Pest Control's total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Wildlife Exclusion service under this Agreement. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Single-Pest & Specialty

Roach Service

Limited 60-Day Roach Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants the Roach Treatment service against re-emergence of covered cockroach activity inside the Structure only for a period of sixty (60) days. The Roach Treatment service consists of two (2) scheduled visits performed approximately 10–14 days apart; in rare cases a third (3rd) visit may be specified in the Notes section of the Service Agreement. The Warranty period begins on the date the final scheduled visit is completed and expires sixty (60) days thereafter; all scheduled visits must be completed for the Warranty to take effect. Covered species include German, American, Smokybrown, Oriental, and Asian cockroaches at the original treated address. If covered cockroach activity occurs indoors within the Warranty period, On Demand Pest Control will return and re-treat at no additional charge as set forth in Section 5.

2Not Transferable

This Warranty applies solely to the original Purchaser at the original treated address. It is not transferable. The Warranty terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Exterior or Outdoor Activity. Cockroach activity occurring outside the Structure, including on the exterior of the building, in the landscape, in mulch beds, on patios, decks, driveways, sewer or storm-drain access points, or anywhere outside the conditioned interior space. This Warranty is for indoor activity only.
  2. Other Pest Species. Any pest species other than the cockroach species listed in Section 1. Bed bugs, ants, termites, rodents, and other species require separate treatment programs and are not covered under this Warranty.
  3. Heavy Pre-Existing Infestation Loads. Severe German cockroach infestations and similar heavy infestation loads may require additional follow-up visits beyond the two scheduled services. On Demand Pest Control will identify these conditions during the first visit and provide a written quote for additional service if needed; declining recommended additional service voids this Warranty.
  4. Attic Access; Damage from Attic Access. Purchaser acknowledges and agrees that On Demand Pest Control must walk on and otherwise access the attic, including its support structures, joists, trusses, decking, insulation, and adjoining interior service areas of the Structure, in order to perform the Services contemplated by this Agreement, and Purchaser grants On Demand Pest Control such access. Purchaser further acknowledges that, no matter what degree of care is exercised, damage to attic structures, support members, joists, trusses, decking, insulation, drywall, finished ceilings, light fixtures, recessed cans, vent components, ductwork, or any other interior or attic system component may be unavoidable in the course of such access, and that such damage may be caused or contributed to by pre-existing structural conditions including (without limitation) termite-damaged or compromised framing, water-damaged or rotted members, framing affected by prior leaks or moisture intrusion, defective original construction, and undersized or improperly installed structural components. Purchaser hereby releases On Demand Pest Control from any and all claims of damage to the attic, ceilings, or any of their components resulting from such access, whether or not such damage was foreseeable.
  5. Conducive Conditions and Sanitation. Re-infestation caused or contributed to by conducive conditions, including but not limited to moisture intrusion, plumbing leaks, standing water, food debris, unsealed food storage, pet food left out, accumulated trash, grease buildup in kitchen areas, clutter and cardboard harborage, drain or sewer line issues, or any sanitation issue that promotes cockroach activity. The Purchaser is responsible for correcting conducive conditions identified by On Demand Pest Control.
  6. New Entry Points and Construction Changes. Activity caused by new entry points, structural alterations, additions, remodeling, new landscaping, or any change to the Structure or surrounding property occurring after the final scheduled service is completed.
  7. Missed or Refused Visit. If the Purchaser cancels, refuses, or repeatedly fails to provide access for any scheduled service visit, the Warranty does not take effect. The Warranty period begins only upon completion of the final scheduled visit.
  8. Acts of God. Any infestation or re-infestation caused or contributed to by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.
  9. Third-Party Treatment. Any treatment, baiting, spraying, or pest control work performed by parties other than On Demand Pest Control after the final scheduled service. Third-party intervention voids this Warranty.
  10. Property Damage by Cockroaches. Any damage to property caused by cockroaches themselves, including but not limited to damaged food, contaminated surfaces, damaged paper goods, damaged textiles, or any other property damage.

4Purchaser Responsibilities

As a condition of this Warranty: Purchaser must allow all scheduled services to be completed; the Warranty period does not begin until the final scheduled visit is performed. Purchaser must promptly notify On Demand Pest Control of any indoor cockroach activity observed during the Warranty period. Purchaser must provide reasonable access to the Structure, including interior rooms and accessible attic spaces, for inspection and re-treatment. Purchaser must address sanitation and conducive conditions identified by On Demand Pest Control, including moisture issues, food and trash storage, kitchen cleanliness, clutter and cardboard harborage, and drain or plumbing issues. Purchaser must not engage any third party to apply pest control products inside the Structure during the Warranty period; doing so voids the Warranty.

5Warranty Service

This Warranty is provided on a reactive basis. On Demand Pest Control does not perform scheduled or proactive follow-up visits after the final scheduled service except as triggered by a Warranty claim. Upon Purchaser's notice of indoor cockroach activity within the Warranty period, On Demand Pest Control will schedule a re-treatment visit at no additional charge. If inspection at the time of the re-treatment determines the activity is not covered under this Warranty (for example, exterior activity, a non-covered species, conducive conditions not corrected, or any condition listed in Section 3 above), On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is to perform re-treatment as set forth in Section 5. On Demand Pest Control's total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Roach Treatment service under this Agreement. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Ant Service

Limited 60-Day Ant Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants the Ant Treatment service against re-emergence of covered ant activity inside the Structure only for a period of sixty (60) days. The Warranty period begins on the date the second scheduled service is completed and expires sixty (60) days thereafter. The Ant Treatment service consists of two (2) scheduled visits performed approximately 10–14 days apart; both visits must be completed for the Warranty to take effect. Covered species include ghost ants, big-headed ants, white-footed ants, Caribbean crazy ants, Argentine ants, and other common nuisance ant species at the original treated address. If covered ant activity occurs indoors within the Warranty period, On Demand Pest Control will return and re-treat at no additional charge as set forth in Section 5.

2Not Transferable

This Warranty applies solely to the original Purchaser at the original treated address. It is not transferable. The Warranty terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Exterior or Outdoor Activity. Ant activity occurring outside the Structure, including on the exterior of the building, in the landscape, in mulch beds, on patios, decks, driveways, or anywhere outside the conditioned interior space. This Warranty is for indoor activity only.
  2. Carpenter Ants and Wood-Destroying Species. Carpenter ants and any other wood-destroying or wood-infesting organisms regulated under Florida WDO standards. Treatment of wood-destroying species requires a separate WDO inspection and contract.
  3. Fire Ants. Red imported fire ants (Solenopsis invicta) and similar stinging or mound-building ant species, which require separate exterior baiting and treatment programs.
  4. Attic Access; Damage from Attic Access. Purchaser acknowledges and agrees that On Demand Pest Control must walk on and otherwise access the attic, including its support structures, joists, trusses, decking, insulation, and adjoining interior service areas of the Structure, in order to perform the Services contemplated by this Agreement, and Purchaser grants On Demand Pest Control such access. Purchaser further acknowledges that, no matter what degree of care is exercised, damage to attic structures, support members, joists, trusses, decking, insulation, drywall, finished ceilings, light fixtures, recessed cans, vent components, ductwork, or any other interior or attic system component may be unavoidable in the course of such access, and that such damage may be caused or contributed to by pre-existing structural conditions including (without limitation) termite-damaged or compromised framing, water-damaged or rotted members, framing affected by prior leaks or moisture intrusion, defective original construction, and undersized or improperly installed structural components. Purchaser hereby releases On Demand Pest Control from any and all claims of damage to the attic, ceilings, or any of their components resulting from such access, whether or not such damage was foreseeable.
  5. Conducive Conditions and Sanitation. Re-infestation caused or contributed to by conducive conditions, including but not limited to moisture intrusion, plumbing leaks, standing water, food debris, unsealed food storage, pet food left out, accumulated trash, heavy vegetation contacting the Structure, or any sanitation issue that promotes ant activity. The Purchaser is responsible for correcting conducive conditions identified by On Demand Pest Control.
  6. New Entry Points and Construction Changes. Activity caused by new entry points, structural alterations, additions, remodeling, new landscaping, or any change to the Structure or surrounding property occurring after the second scheduled service is completed.
  7. Missed or Refused Second Visit. If the Purchaser cancels, refuses, or repeatedly fails to provide access for the second scheduled service, the Warranty does not take effect. The Warranty period begins only upon completion of the second visit.
  8. Acts of God. Any infestation or re-infestation caused or contributed to by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.
  9. Third-Party Treatment. Any treatment, baiting, spraying, or pest control work performed by parties other than On Demand Pest Control after the second scheduled service. Third-party intervention voids this Warranty.
  10. Property Damage by Ants. Any damage to property caused by ants themselves, including but not limited to damaged food, damaged electronics, damaged textiles, or any other property damage.

4Purchaser Responsibilities

Purchaser must promptly notify On Demand Pest Control of any indoor ant activity observed during the Warranty period. 5Warranty Service

This Warranty is provided on a reactive basis. On Demand Pest Control does not perform scheduled or proactive follow-up visits after the second service except as triggered by a Warranty claim. Upon Purchaser's notice of indoor ant activity within the Warranty period, On Demand Pest Control will schedule a re-treatment visit at no additional charge. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Mosquito Service

Limited Mosquito Service Warranty

1Coverage And Scope Of Service

On Demand Pest Control will install, inspect, and maintain In2Care® mosquito stations and apply a power-misting insecticide treatment to landscape foliage on the Purchaser’s property at the interval set forth on page 1 of this Agreement and in the associated Credit Card Authorization, for the term of this Agreement. THE PURPOSE OF THIS SERVICE IS TO REDUCE MOSQUITO POPULATIONS AND BREEDING ACTIVITY ON THE TREATED PROPERTY. ON DEMAND PEST CONTROL DOES NOT WARRANT, REPRESENT, OR GUARANTEE THAT MOSQUITOES WILL BE ELIMINATED, ERADICATED, OR ABSENT FROM THE PROPERTY AT ANY TIME. Mosquitoes are flying insects that travel freely from neighboring properties, waterways, drainage features, and untreated areas; the presence of mosquitoes, bites, swarms after rain, and seasonal surges are not failures of the service.

2Not Transferable

This Agreement and the service performed under it apply solely to the original Purchaser at the original treated address. The Agreement is not transferable. The Agreement terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address. The new owner may request a new service agreement at On Demand Pest Control’s then-current rates.

3What Is Not Covered

This Agreement does not cover, and On Demand Pest Control has no obligation under this Agreement with respect to, any of the following:

  1. Eradication or Zero Mosquitoes. Any expectation, representation, or warranty that mosquitoes will be eliminated, eradicated, or absent from the property. This is a population-reduction service. Mosquitoes may continue to be present, particularly after rainfall, during peak seasons, in shaded or vegetated areas, and on properties adjacent to canals, lakes, swales, ponds, marshes, or other water features.
  2. Off-Site and Migrating Mosquitoes. Mosquitoes originating from or migrating from properties, structures, common areas, easements, drainage features, waterways, or any area outside the boundaries of the treated property.
  3. Bites, Health, and Disease. Any bite, allergic reaction, illness, infection, or disease — including without limitation Zika virus, dengue fever, West Nile virus, chikungunya, eastern equine encephalitis, malaria, or any other mosquito-borne illness — suffered by any person or animal on or off the property.
  4. Property Damage Caused by Mosquitoes or Other Pests. Any property damage, contamination, or loss attributable to mosquitoes or any other pest. This Agreement does not provide for the repair, replacement, or compensation of any property damage.
  5. Standing Water and Breeding Sources on the Property. Mosquito activity attributable to standing water or breeding sources that the Purchaser fails to remove, drain, or correct after reasonable notice. Common examples include uncovered rain barrels, clogged gutters, plant saucers, unused pools or hot tubs, bird baths, tires, tarps, and any container holding water for more than five (5) days.
  6. Indoor Mosquito Activity. Mosquitoes inside any structure on the property. This service treats the exterior premises only.
  7. Pesticide and Vegetation Sensitivities. Any allergic reaction or sensitivity to applied insecticides by persons, pets, fish, or non-target animals; and any sensitivity, discoloration, or damage to vegetation, edible plants, koi or fish ponds, water features, or beneficial insects when On Demand Pest Control has not been informed in writing of those sensitivities prior to treatment.
  8. Gate, Fence, and Access Damage. Damage to gates, latches, locks, hinges, fence panels, fence posts, screens, screen enclosures, pool cages, lanai doors, landscape lighting, irrigation heads, or any other property feature resulting from the ordinary opening, closing, and traversal of those features in the course of accessing the property. The Purchaser acknowledges that incidental contact and ordinary wear may occur in the course of property access and releases On Demand Pest Control from any claim for such damage.
  9. Denied or Restricted Access. Any reduction in service effectiveness, or any missed scheduled visit, resulting from locked gates without provided codes or keys, unrestrained pets, construction or landscaping activity, or any other condition that prevents On Demand Pest Control from accessing all areas of the property required to perform the service. Missed visits due to denied access are not rescheduled at no charge and do not entitle the Purchaser to a credit or refund.
  10. Station Disturbance, Damage, or Theft. Any failure of mosquito stations caused by interference, damage, relocation, removal, or theft by the Purchaser, occupants, guests, pets, animals, lawn-care providers, pool-service providers, or other third parties. On Demand Pest Control reserves the right to charge for replacement stations damaged or lost through such causes.
  11. Acts of God and Severe Weather. Reduced effectiveness or damage caused by hurricanes, tropical storms, flooding, prolonged heavy rainfall, wildfires, freezes, or other acts of God. Surges in mosquito populations following such events are anticipated and are not a failure of the service.
  12. Conditions Conducive to Mosquito Breeding Not Corrected by Purchaser. Any continued mosquito activity attributable to property conditions that On Demand Pest Control has reported to the Purchaser as conducive to mosquito breeding or harborage, and that the Purchaser has not corrected within a reasonable time. Additional treatments in such areas may be performed at the Purchaser’s expense at standard rates.

4Purchaser Responsibilities

As a condition of this Agreement and the service performed under it: Purchaser must provide On Demand Pest Control with full access to the property — including all yards, side yards, pool decks, and other exterior areas — on or before each scheduled service date. This includes functional gate codes, keys, or unlocked gates; restraining pets during scheduled visits; and notifying On Demand Pest Control of any access change or planned landscaping, fence replacement, pool installation, or other construction work that may affect station placement or yard access. Purchaser is responsible for eliminating standing water and known breeding sources on the property — including without limitation emptying plant saucers, uncovered containers, tarps, tires, and clogged gutters — and for promptly addressing any conditions On Demand Pest Control identifies as conducive to mosquito breeding or harborage. Purchaser must promptly notify On Demand Pest Control of any significant increase in mosquito activity, damaged stations, suspected pesticide sensitivities, or any new pet, koi pond, beehive, or ornamental feature that may require special handling during treatment. Purchaser must not tamper with, move, remove, or alter the installed mosquito stations or their contents. The biological agents and larvicide inside the stations are regulated pesticide products and must remain undisturbed.

5Service Cadence

Scheduled service visits occur at the recurring interval set forth on page 1 of this Agreement and in the associated Credit Card Authorization during the Initial Term and any renewal term. Scheduling is subject to weather, technician availability, and Purchaser access to the property as set forth in Section 4 above.

6Limitation Of Remedy

On Demand Pest Control’s sole and exclusive obligation under this Agreement is to perform the scheduled recurring service in accordance with Sections 1 and 5. On Demand Pest Control’s total liability under this Agreement shall not exceed the amount paid by the Purchaser for the three (3) most recent scheduled service visits. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR LOSS-OF-ENJOYMENT DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, REGARDLESS OF THEORY.

Bee Service

Limited Bee Service Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants the one-time treatment of the active honey bee or wasp colony performed under this Agreement for a period of sixty (60) days from the date of treatment, at the original treated address only. If the treated colony reactivates, or if new bee or wasp activity returns at the same entry point identified on the front page of this Agreement within the sixty (60) day Warranty period, On Demand Pest Control will re-treat that colony at no additional charge. This Warranty is expressly conditioned on the Purchaser's timely sealing of the treated entry point as set forth in Section 4.

2Not Transferable

This Warranty applies solely to the original Purchaser at the original treated address. It is not transferable. The Warranty terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address, or (c) expiration of the sixty (60) day Warranty period, whichever occurs first.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Hive, Comb, Honey, and Wax Removal. Physical removal of the hive, comb, honey, wax, dead bees, or any other colony material is expressly NOT included in the services provided under this Agreement. On Demand Pest Control treats the active colony only.
  2. Structural Access. On Demand Pest Control does not cut, open, remove, or otherwise access walls, ceilings, floors, soffits, eaves, or any other structural component to reach a colony. Treatment is performed from the exterior entry point only.
  3. Damage From Dying Colony or Residual Materials. On Demand Pest Control is not liable for any damage caused by the dying colony, decomposing bees or wasps, honey leakage, wax melting, mold, staining, odors, or secondary pest attraction (including ants, roaches, rodents, or other insects drawn to honey or comb) — whether the residual materials are located inside walls, ceilings, attics, soffits, or any other location. The Purchaser acknowledges that residual hive material may cause property damage over time and that removal of such material — by the Purchaser or a qualified third party — is the Purchaser's sole responsibility.
  4. Failure to Seal Entry Point. Any re-infestation or new colony establishment caused by the Purchaser's failure to seal the treated entry point with appropriate materials after the pheromone clearance period, as set forth in Section 4. Bees and wasps are strongly attracted to residual pheromones left by the previous colony, and an unsealed entry point will, in the ordinary course, result in reactivation not covered by this Warranty.
  5. Activity Outside Warranty Scope. Activity at any entry point other than the one identified on the front page; any new colony at a different location on or near the Structure; and any activity occurring after the sixty (60) day Warranty period.
  6. Stinging, Allergic Reactions, and Bee-Caused Damage. Any injury, allergic reaction, anaphylaxis, or property damage caused by bees, wasps, or other stinging insects themselves, whether before, during, or after treatment. The Purchaser is responsible for keeping people and pets at a safe distance during treatment and the pheromone clearance period.
  7. Africanized Bee Identification. On Demand Pest Control does not perform species-level identification (European vs. Africanized honey bee). Consistent with Florida Department of Agriculture and Consumer Services guidance, all wild colonies are treated as potentially Africanized.
  8. Swarms. Transient bee swarms (clusters in transit that have not established a colony at the location). Swarms typically move on within 24–72 hours without treatment; if a swarm establishes a colony, a new service call and Agreement are required.
  9. Acts of God and Treatment Site Disturbance. Loss of treatment efficacy caused by hurricanes, tropical storms, heavy rainfall, floods, fire, or other acts of God; or by interference with the treated entry point by parties other than On Demand Pest Control.
  10. Pre-Existing Decay or Damage. Any pre-existing structural decay, water damage, termite damage, or other compromised condition at or near the treated entry point or surrounding Structure. The Purchaser is responsible for arranging proper repair by a qualified third party.
  11. Third-Party Alteration. Any alteration of the Structure, the treated entry point, or surrounding area by parties other than On Demand Pest Control after treatment, including but not limited to new roofing, siding, soffit or fascia work, painting, sealing by another contractor, or any other modification that disturbs the treated area. Such alteration voids this Warranty as to the affected area.
  12. Roof Access; Damage from Roof Access. On Demand Pest Control may need to access the roof, eaves, soffits, fascia, or attic vents of the Structure to reach the entry point, and Purchaser grants On Demand Pest Control such access. Despite the exercise of reasonable care, damage to roof tiles, shingles, gutters, vents, flashing, or other roofing components may occur. Purchaser releases On Demand Pest Control from any and all claims of damage to the roof or its components resulting from such access, whether or not foreseeable.

4Purchaser Responsibilities

As a condition of this Warranty: Purchaser must keep people, pets, and food away from the treated area for at least 24 hours after treatment, and must observe any longer site-specific instructions provided by the technician. Purchaser must disclose any known severe stinging-insect allergies or anaphylaxis risk in the household prior to treatment. Purchaser must allow the full pheromone clearance period to elapse — typically seven (7) to fourteen (14) days, or as specifically instructed by the technician at time of service — before sealing the entry point. Sealing before activity has fully ceased may trap live insects inside the structure and is the Purchaser's risk. Purchaser must seal the treated entry point with appropriate materials (such as caulk, hardware cloth, foam sealant, mortar, or other materials suited to the entry point) promptly after activity has ceased. The Purchaser may engage a qualified third party to perform the sealing work. FAILURE TO SEAL THE ENTRY POINT WILL, IN THE ORDINARY COURSE, RESULT IN RE-INFESTATION DUE TO RESIDUAL PHEROMONES, AND ANY SUCH RE-INFESTATION IS NOT COVERED BY THIS WARRANTY. Purchaser must promptly notify On Demand Pest Control of any continued or renewed bee or wasp activity at the treated entry point during the Warranty period, and must provide reasonable access to the treated entry point and surrounding area for any inspection or re-treatment under this Warranty.

5Warranty Service

This Warranty is provided on a reactive basis. On Demand Pest Control does not perform scheduled or proactive inspections during the Warranty period. Upon Purchaser's notice of continued or renewed bee or wasp activity at the treated entry point within the sixty (60) day Warranty period, On Demand Pest Control will schedule an inspection at no charge. If the inspection determines that the original treated colony has reactivated at the same entry point, On Demand Pest Control will re-treat at no additional charge. If the inspection determines the activity is at a new entry point, is a new colony unrelated to the original treatment, falls within an exclusion set forth in Section 3 above (including Purchaser's failure to seal as required by Section 4), or occurs after the Warranty period, On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is to re-treat covered colony activity as set forth in Section 1. On Demand Pest Control's total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Bee Service under this Agreement. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Flea & Tick — Bi-Monthly

Limited Flea & Tick Protection Plan Warranty

1Coverage

Subject to the terms below, On Demand Pest Control will perform flea and tick treatment at the original treated address in the treatment area(s) selected on the front page of this Agreement (interior, exterior, or both). The initial treatment consists of two (2) visits approximately fourteen (14) days apart; the second visit is intended to interrupt the flea life cycle by treating newly emerged fleas before they can reproduce. Following the initial treatment, On Demand Pest Control will return every sixty (60) days to perform recurring maintenance treatment for the duration of this Agreement. While the Purchaser is active on this Agreement and current on all payments, On Demand Pest Control will perform additional re-service visits between scheduled treatments at no additional charge if covered flea or tick activity is reported by the Purchaser in the selected treatment area(s).

2Term, Renewal, And Cancellation; Not Transferable

Initial Term. This Agreement has an initial term of twelve (12) months, beginning on the date of the first visit. Renewal. After the initial term expires, this Agreement automatically renews on a month-to-month basis at the then-current recurring rate, and continues to renew month-to-month until cancelled. Cancellation by Purchaser. The Purchaser may cancel this Agreement at any time after the initial term by providing thirty (30) days' written notice to On Demand Pest Control. The Purchaser may also cancel during the initial term, but if cancellation occurs before the initial term ends, the free re-services included with this Agreement cease as of the cancellation effective date and the Purchaser remains responsible for all amounts owed for services already performed. Cancellation by On Demand Pest Control. On Demand Pest Control may cancel this Agreement upon thirty (30) days' written notice (or sooner, under Section 13, for non-payment or default). Not Transferable. This Agreement applies solely to the original Purchaser at the original treated address. It is not transferable and terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address.

3What Is Not Covered

This Agreement does not cover, and On Demand Pest Control has no obligation under this Agreement with respect to, any of the following:

  1. Pests Other Than Fleas and Ticks. This Agreement applies only to fleas and ticks. Any other pest (including but not limited to ants, roaches, bed bugs, mosquitoes, spiders, or mites) is not covered. On Demand Pest Control will, upon request, quote separate service for any non-covered pest.
  2. Areas Not Selected for Treatment. Any treatment area not selected on the front page of this Agreement is not covered. For example, if only the exterior was selected, flea or tick activity discovered inside the structure is not covered.
  3. Pets and Animals. On Demand Pest Control does not treat pets or other animals and is not licensed to do so. Fleas and ticks living on pets must be treated by a licensed veterinarian. Re-infestation of treated areas caused by untreated pets, visiting animals, or outdoor animals is not covered.
  4. Outdoor Animals and External Sources. Re-infestation introduced by outdoor animals (including but not limited to raccoons, opossums, small mammals, stray cats, deer, or birds), neighboring properties, or outdoor sources beyond the treated area is not covered.
  5. Free Re-Services When Account Is Not Active or Current. The free re-service benefit applies only while the Purchaser is active on this Agreement and current on all payments. Lapsed, suspended, or cancelled accounts forfeit the free re-service benefit immediately upon lapse, suspension, or cancellation.
  6. Failure to Perform Customer Responsibilities. Any failure of the Purchaser to perform the pre-treatment preparation set forth in Section 4 (including without limitation removing pets from the treatment area during application, vacuuming carpeted areas prior to interior treatment, washing pet bedding, or arranging concurrent veterinary treatment of pets) may reduce treatment effectiveness and is not covered.
  7. Property Damage. Any damage to flooring, carpeting, furniture, fabrics, plants, or other property arising from the treatment is not covered. The Purchaser is responsible for protecting or removing sensitive items from the treatment area prior to service.
  8. Heavy or Pre-Existing Infestation. Severe or established infestations may require additional treatment beyond the standard initial visits. Where the Inspector identifies a heavy or pre-existing infestation at the first visit, additional treatment may be quoted separately at standard rates.
  9. Missed or Denied Service Visits. If the Purchaser denies access for a scheduled visit, fails to provide reasonable access after two (2) attempts to reschedule, or reschedules indefinitely, the visit will be deemed performed for purposes of this Agreement and billed as scheduled. Repeated denials may result in suspension or termination under Section 13.
  10. Weather and Environmental Conditions. Heavy rainfall within twenty-four (24) hours of an exterior treatment, irrigation, flooding, or similar conditions may wash away exterior product and reduce its effectiveness. Re-treatment necessitated by such conditions, while the Purchaser is active on this Agreement, is covered as a free re- service; loss of efficacy caused by ongoing or repeated conditions of this kind is not separately compensable.
  11. Acts of God. Damage, contamination, or loss of treatment efficacy caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.

4Purchaser Responsibilities

As a condition of this Agreement and the free re-service benefit: Purchaser must allow both initial treatment visits to be performed approximately fourteen (14) days apart and must allow scheduled recurring visits to be performed approximately every sixty (60) days thereafter. Purchaser must, for interior treatment, vacuum all carpeted and upholstered areas to be treated immediately prior to each visit and dispose of the vacuum bag or contents outside the structure. Purchaser must wash pet bedding, blankets, and any soft items where pets rest in hot water prior to service and continue weekly between visits. Purchaser must remove pets, fish tanks (cover and turn off air pumps), birds, and reptiles from the treatment area during application and for the re-entry period instructed by the Inspector. Purchaser must arrange for any pets to be concurrently treated for fleas and ticks by a licensed veterinarian; treatment of the structure alone will not control an infestation if pets are not also treated. Purchaser must provide reasonable access to the Structure and the selected treatment area(s) for every scheduled visit and any requested re-service. Purchaser must promptly notify On Demand Pest Control of any flea or tick activity observed between scheduled visits. Purchaser must remain current on all payments. Lapse in payment suspends the free re-service benefit and may result in termination under Section 13. Purchaser must disclose any household member, visitor, or pet with chemical sensitivities, respiratory conditions, or medical concerns prior to treatment, and disclose the presence of beneficial pollinators (e.g., active beehives) on the property.

5Service Cadence And Re-Service

On Demand Pest Control will perform the initial two-visit treatment, then return every sixty (60) days to perform maintenance treatment for the duration of this Agreement. Scheduled visit dates may be adjusted by mutual agreement to accommodate weather, holidays, or Purchaser availability. Between scheduled visits, the Purchaser may request additional re-service if flea or tick activity is observed; provided the Purchaser is active on this Agreement and current on all payments, On Demand Pest Control will schedule and perform such re-service at no additional charge, typically within seven (7) business days of the request. Re-service is limited to the selected treatment area(s); requests outside the selected area(s) or for non-covered pests (Section 3) will be quoted separately.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Agreement is to perform the scheduled treatments and any covered free re-services as set forth in Section 5. On Demand Pest Control's total liability under this Agreement shall not exceed the total amount paid by the Purchaser under this Agreement in the twelve (12) months preceding the event giving rise to the claim. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, VETERINARY EXPENSES, OR LOSS OF ENJOYMENT.

Flea & Tick — One-Time

Limited Flea & Tick Treatment Warranty

1Coverage

Subject to the terms below, On Demand Pest Control will perform two (2) flea and tick treatment visits at the original treated address, approximately fourteen (14) days apart, in the treatment area(s) selected on the front page of this Agreement (interior, exterior, or both). The second visit is intended to interrupt the flea life cycle by treating newly emerged fleas before they can reproduce. Following completion of the second visit, On Demand Pest Control warrants the selected treatment area(s) against flea and tick activity for a period of sixty (60) days from the date the second visit is completed (the "Warranty Period"). If covered flea or tick activity is reported by the Purchaser within the Warranty Period, On Demand Pest Control will return and perform additional treatment of the affected treatment area(s) at no additional charge.

2Not Transferable

This Warranty applies solely to the original Purchaser at the original treated address. It is not transferable. The Warranty terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  6. Failure to Perform Customer Responsibilities. Any failure of the Purchaser to perform the pre-treatment preparation set forth in Section 4, including without limitation removing pets from the treatment area during application, vacuuming carpeted areas prior to interior treatment, and washing pet bedding, may reduce treatment effectiveness and voids this Warranty.
  7. Property Damage. Any damage to flooring, carpeting, furniture, fabrics, plants, or other property arising from the treatment is not covered. The Purchaser is responsible for protecting or removing sensitive items from the treatment area prior to service.
  8. Heavy or Pre-Existing Infestation. Severe or established infestations may require additional treatment beyond the two visits. Where the Inspector identifies a heavy or pre-existing infestation at the first visit, additional treatment may be quoted separately at standard rates; the Warranty applies only after such additional treatment, if accepted, is completed.
  9. Re-Treatment Outside the Warranty Period. Any flea or tick activity reported after the sixty (60) day Warranty Period has expired. Additional treatment after the Warranty Period will be quoted separately.
  10. Weather and Environmental Conditions. Heavy rainfall within twenty-four (24) hours of an exterior treatment, irrigation, flooding, or similar conditions may wash away exterior product and reduce its effectiveness. Re-treatment necessitated by such conditions, if performed within the Warranty Period, is covered; loss of efficacy caused by ongoing or repeated conditions of this kind is not covered.
  11. Acts of God. Damage, contamination, or loss of treatment efficacy caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.

5Warranty Service

This Warranty is provided on a reactive basis. Upon Purchaser's notice of flea or tick activity within the Warranty Period, On Demand Pest Control will schedule an inspection of the affected treatment area(s) at no charge. If the inspection confirms covered flea or tick activity, On Demand Pest Control will re-treat the affected treatment area(s) at no additional charge. If the inspection determines the issue is not covered under this Warranty (for example, activity in a non-selected area, a different pest, or any condition listed in Section 3 above), On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is to re-treat the affected selected treatment area(s) as set forth in Section 5. On Demand Pest Control's total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Flea & Tick Treatment service under this Agreement. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, VETERINARY EXPENSES, OR LOSS OF ENJOYMENT.

Attic & Add-On Services

Attic Dusting

1Scope Of Service; No Warranty On Pest Activity

This Agreement covers a one-time application of EPA-registered insecticidal dust (such as diatomaceous earth, boric acid, or a labeled crawling-pest dust) to attic surfaces and harborage areas at the service address identified on the first page. On Demand Pest Control warrants only that the product was applied in accordance with the manufacturer's label specifications as of the date of service. ON DEMAND PEST CONTROL MAKES NO WARRANTY, EXPRESS OR IMPLIED, AS TO PEST ACTIVITY REDUCTION, PEST ELIMINATION, PREVENTION OF RE-INFESTATION, OR ANY SPECIFIC RESULT FROM THIS APPLICATION. Pest activity outcomes depend on numerous factors outside On Demand Pest Control's control, including but not limited to attic conditions, moisture levels, food sources, structural openings, surrounding properties, and customer housekeeping. This service is provided on an as-applied basis with no ongoing performance commitment. No follow-up visits, reinspections, or re-treatments are included.

2Not Transferable

This Agreement and the application performed under it are non-transferable and apply solely to the original Purchaser at the original treated address. Any obligations of On Demand Pest Control under this Agreement terminate automatically upon sale, transfer, or change of ownership of the property.

3What Is Not Covered

This Agreement does not cover, and On Demand Pest Control has no obligation with respect to, any of the following:

  1. Pest Activity After Service. Any continuing, recurring, or new pest activity within the structure following the application, including but not limited to roaches, ants, silverfish, spiders, beetles, or any other crawling or flying pest. This service is an application, not a guarantee of pest absence.
  2. Wood-Destroying Organisms. Drywood termites, subterranean termites, Formosan termites, dampwood termites, wood-destroying beetles, carpenter ants, or any other wood-destroying pest or organism. Attic Dusting is not a wood-destroying-organism treatment and provides no protection against any wood- destroying pest.
  3. Rodents and Wildlife. Rats, mice, squirrels, raccoons, opossums, bats, birds, or any other rodent or wildlife species. Insecticidal dust does not control vertebrate pests.
  4. Attic and Roof Access; Pre-Existing Structural Conditions. Performance of this service requires On Demand Pest Control technicians to walk on and otherwise access attic spaces and, in limited cases, related roof access points. The Purchaser grants On Demand Pest Control such access. ON DEMAND PEST CONTROL IS NOT LIABLE FOR DAMAGE TO ATTIC STRUCTURAL MEMBERS, FINISHED CEILINGS, DRYWALL, INSULATION, ROOF DECKING, OR OTHER PROPERTY CAUSED OR CONTRIBUTED TO BY PRE-EXISTING CONDITIONS, INCLUDING BUT NOT LIMITED TO: TERMITE- DAMAGED OR COMPROMISED JOISTS, RAFTERS, TRUSSES, DECKING, OR FRAMING; WATER-DAMAGED, ROTTED, OR MOISTURE-AFFECTED FRAMING; FRAMING AFFECTED BY PRIOR LEAKS OR MOISTURE INTRUSION; DEFECTIVE ORIGINAL CONSTRUCTION; UNDERSIZED, MIS- SPACED, OR IMPROPERLY INSTALLED STRUCTURAL MEMBERS; CONCEALED PRIOR REPAIRS; AND ANY OTHER LATENT DEFECT. Ordinary, non- negligent access marks — including displaced insulation, dust, footprints, and minor stress at attic-hatch perimeters — are inherent to the work and are not covered. This Section 3(d) is the negotiated allocation of risk for service performed in spaces On Demand Pest Control did not construct, maintain, or previously inspect.
  5. Areas Outside the Attic. Living spaces, garages, exterior surfaces, crawl spaces, or any area other than the attic surfaces identified on the first page. This service treats the attic only.
  6. Inaccessible or Denied Areas. Any attic area, structural member, or harborage that the Purchaser denies access to, that is physically inaccessible (e.g., walled-in attic sections, areas behind permanent finishes), or that was not identified for treatment on the first page.
  7. Product Disturbance or Removal. Any reduction in product effectiveness caused by subsequent disturbance, including but not limited to: HVAC work, insulation replacement, electrical work, roofing work, water intrusion, or any other activity that disturbs, contaminates, or removes the applied dust.
  8. Moisture and Water Damage. Any moisture-related condition, including fungus, water leakage from faulty plumbing, roof leaks, gutters, downspouts, or poor drainage. Moisture significantly reduces the effectiveness of dust-based applications, and Purchaser is responsible for addressing moisture issues identified by On Demand Pest Control.
  9. Property Damage from Pests. Any damage to the structure, contents, wiring, insulation, or other property caused by pests, whether before, during, or after this service.
  10. Acts of God. Damage or failure of the application caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.

4Purchaser Responsibilities

As a condition of this Agreement: Purchaser must provide reasonable access to the Structure, including attic spaces and any other areas designated for treatment. Purchaser must disclose any known structural issues, prior pest treatments, or attic conditions before service. Purchaser must vacate the immediate work area during application and ventilate per any instructions provided by the technician. Purchaser must, at Purchaser's expense, repair or remediate any pre-existing structural condition identified by On Demand Pest Control that affects the safety of attic access or the integrity of the Structure. Purchaser must make timely repairs to stop water leakage or moisture intrusion identified by On Demand Pest Control.

5No Re-Service Or Reinspection

This Agreement does not include any follow-up visits, reinspections, re-treatments, or warranty service of any kind. If the Purchaser wishes to schedule additional dust application or any other pest control service after this one-time application, On Demand Pest Control will provide a written quote, which the Purchaser may accept or decline.

6Limitation Of Remedy

Purchaser's sole and exclusive remedy for any claim arising out of or relating to this Agreement or the service performed hereunder shall be limited to a refund of the amount paid by the Purchaser for the Attic Dusting service, and On Demand Pest Control's total liability shall not exceed that amount. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Attic Remediation

Limited Warranty

1Coverage

Subject to the terms below, On Demand Pest Control warrants the Insulation Service and the Disinfecting Service performed under this Agreement as follows: TAP® Pest Control Insulation. The TAP® cellulose insulation installed by On Demand Pest Control will be free from defects in material and workmanship for a period of one (1) year from the date of installation. If during that period any portion of the installed insulation fails because of defective material or workmanship, On Demand Pest Control will, at its option, repair or replace the affected portion at no additional charge. This Warranty does not guarantee any specific energy savings, R-value performance, or pest-deterrent outcome, all of which depend on conditions outside On Demand Pest Control's control. Disinfecting Service. On Demand Pest Control warrants that the EPA-registered disinfectant was applied in accordance with its label and manufacturer specifications to the areas designated for treatment as of the date of service. Because disinfectant performance is inherently time-limited and depends on the absence of new contamination, this Warranty does not extend beyond the date of treatment and does not cover re-contamination, new infestation, or any condition arising after service.

2Not Transferable

This Warranty applies solely to the original Purchaser at the original treated address. It is not transferable. The Warranty terminates automatically upon (a) sale, transfer, or change of ownership of the property, or (b) the Purchaser no longer occupying or owning the original treated address.

3What Is Not Covered

This Warranty does not cover, and On Demand Pest Control has no obligation under this Warranty with respect to, any of the following:

  1. Pest Activity, Re-Infestation, and Re-Contamination. Neither the Insulation Service nor the Disinfecting Service guarantees the absence, elimination, or non- return of any pest, and pest activity in the attic or elsewhere on the property is not a warranty event. Likewise, any biological contamination of the treated area arising after the date of Disinfecting Service — including new rodent or wildlife activity, water intrusion, mold growth, or human-introduced contamination — is not covered, and the Purchaser is responsible for addressing the underlying source. Pest control services are not within the scope of this Agreement.
  2. R-Value or Energy Performance. Any claim related to actual energy savings, utility bill reductions, R-value performance over time, settling of installed material, or thermal performance under specific structural or environmental conditions. R-value is not warranted under this Agreement.
  3. Attic and Roof Access; Pre-Existing Structural Conditions. Performance of the Insulation and Disinfecting services requires On Demand Pest Control technicians to walk on and otherwise access attic spaces and, in limited cases, related roof access points. The Purchaser grants On Demand Pest Control such access. On Demand Pest Control is not liable for damage to attic structural members, finished ceilings, drywall, insulation, roof decking, or other property caused or contributed to by pre-existing conditions, including but not limited to: termite-damaged or compromised joists, rafters, trusses, decking, or framing; water-damaged, rotted, or moisture-affected framing; framing affected by prior leaks or moisture intrusion; defective original construction; undersized, mis-spaced, or improperly installed structural members; concealed prior repairs; and any other latent defect. Ordinary, non-negligent access marks — including displaced insulation, dust, footprints, and minor stress at attic-hatch perimeters — are inherent to the work and are not covered. Damage to roof tiles, shingles, gutters, plumbing vents, flashing, or any other roofing system component that may be unavoidable in the course of roof or attic access is likewise not covered, and the Purchaser releases On Demand Pest Control from all such claims. This Section 3(c) is the negotiated allocation of risk for service performed in spaces On Demand Pest Control did not construct, maintain, or previously inspect, and is supported by the Purchaser's separate initials on the first page.
  4. Moisture and Water Damage. Any moisture-related condition, including fungus, mold, water leakage from faulty plumbing, roof leaks, gutters, downspouts, or poor drainage. Purchaser is responsible for timely repairs to stop any water leakage identified by On Demand Pest Control. Failure to do so terminates this Warranty as to the affected areas.
  5. Wood-Destroying Organisms and Resulting Damage. Damage to insulation, framing, or any other property caused by termites, beetles, carpenter ants, or any other wood-destroying organism — past, present, or future. The borate in TAP® insulation suppresses many crawling pests as an EPA-registered pesticide, but TAP® is not a termite warranty product, and this Agreement is not a Wood-Destroying Organism Inspection or warranty.
  6. Structural Modifications. Any alteration of the Structure(s) after service — including additions, structural modifications, roof replacement, HVAC additions, soil regrading, or solar panel installation — voids this Warranty as to the affected areas unless Purchaser notifies On Demand Pest Control in writing within ten (10) days and arranges for re-inspection or additional treatment at Purchaser's expense.
  7. Tampering or Removal. Any damage to or failure of the installed insulation or treated surfaces caused by tampering, removal, or alteration by anyone other than On Demand Pest Control, including contractors, other service providers, or the Purchaser.
  8. Areas Denied or Inaccessible. Any portion of the attic or other designated service area that the Purchaser denies access to, that is physically inaccessible, or that was not identified for service on the first page of this Agreement.
  9. Asbestos and Hazardous Materials. If asbestos, lead-based paint, vermiculite, or any other hazardous material is identified or suspected in the attic or designated service area, On Demand Pest Control will stop work and notify the Purchaser. Remediation of such materials is the Purchaser's responsibility and is outside the scope of this Agreement.
  10. Wood Repairs and Structural Repairs. This Agreement does not include wood repair, structural repair, drywall repair, ceiling repair, or repair of any other component of the Structure, whether identified before, during, or after service.
  11. Acts of God. Damage to the Structure, the installed insulation, or treated surfaces caused by hurricanes, tropical storms, floods, fire, earthquake, or other acts of God.

4Purchaser Responsibilities

As a condition of this Warranty, Purchaser must: • Provide On Demand Pest Control with reasonable access to the attic, designated service areas, and any other areas required for service or warranty inspection. • Disclose any known structural, moisture, electrical, or hazardous-material conditions in the service area before service begins. • At Purchaser's expense, repair or remediate any pre-existing structural condition identified by On Demand Pest Control that affects the safety of attic access, the effectiveness of service, or the integrity of the Structure. • Make timely repairs to stop any water leakage identified by On Demand Pest Control, as described in Section 3(d). • Notify On Demand Pest Control in writing within ten (10) days of any structural alteration, addition, or modification to the Structure(s) as described in Section 3(f). • Not tamper with, remove, or alter the installed insulation or treated surfaces. • For the Disinfecting Service, ventilate the treated area following manufacturer and inspector instructions, and keep occupants and pets out of the treated area until cleared.

5Warranty Service

This Warranty is provided on a reactive basis. On Demand Pest Control does not perform scheduled or proactive annual reinspections. Upon Purchaser's notice of a defect in the installed insulation within the one-year warranty period, On Demand Pest Control will schedule an inspection at no charge. If the inspection determines that the defect is covered under Section 1, On Demand Pest Control will repair or replace the affected portion at no additional charge. If the inspection determines the issue is not covered (for example, any condition listed in Section 3 above), On Demand Pest Control will provide a written quote for any additional work, which the Purchaser may accept or decline. The Disinfecting Service does not include ongoing warranty service after the date of treatment.

6Limitation Of Remedy

On Demand Pest Control's sole and exclusive obligation under this Warranty is repair or replacement of defective insulation material or workmanship as set forth in Section 5. On Demand Pest Control's total liability under this Warranty shall not exceed the amount paid by the Purchaser for the Insulation Service and Disinfecting Service under this Agreement. ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY, LOSS OF USE, OR LOSS OF ENJOYMENT.

Standard Terms — Part of Every Service Agreement

The following terms are standard across all On Demand Pest Control service agreements. They are reproduced here for transparency. The binding version is the one in your signed agreement for your specific service and address.

7Notice And Mediation

Before initiating arbitration, the party asserting a claim shall send written notice describing the claim and the relief sought to the other party (notice to On Demand Pest Control at 3801 SW 47th Avenue, STE 502, Davie, FL 33314, by certified mail). The parties shall negotiate in good faith for thirty (30) days. If the dispute remains unresolved, the parties shall participate in non-binding mediation administered by the American Arbitration Association ("AAA") in Broward County, Florida, with AAA and mediator fees split equally.

8Binding Arbitration

Any dispute arising out of or relating to this Agreement, the services provided, or the parties' relationship that is not resolved under Section 7 shall be resolved by final and binding arbitration administered by AAA under its Consumer Arbitration Rules (or Commercial Arbitration Rules if the Purchaser is a business entity), before a single neutral arbitrator selected from AAA's Construction/Real Estate Panel or with documented experience in pest control or related industries, using AAA's list-and-rank procedure. The arbitration shall be held in Broward County, Florida, and is governed by the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.) and, to the extent not preempted, the Florida Revised Arbitration Code (Fla. Stat. Ch. 682). Fees shall be allocated under AAA's then-applicable rules; On Demand Pest Control shall pay any consumer fees in excess of the maximum allocable to the consumer under the Consumer Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.

9Waivers, Carve-Outs, And Severability

THE PARTIES EXPRESSLY WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION; ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY. Notwithstanding the foregoing, either party may bring an individual claim in small claims court in Broward County, Florida; either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information; and On Demand Pest Control may pursue collection of unpaid invoices in any court of competent jurisdiction in Broward County. If any portion of this Section is held unenforceable, the remainder shall remain in effect, except that if the class action waiver is held unenforceable, this entire Dispute Resolution provision shall be null and void as to the affected claim. This Section survives termination of this Agreement.

10Purchaser Acknowledgment

By signing this Agreement, the Purchaser acknowledges reading and understanding this Dispute Resolution provision and voluntarily waives the right to a jury trial and the right to participate in a class action.

11Force Majeure

On Demand Pest Control shall not be in breach of this Agreement, and its performance shall be excused or suspended, to the extent that On Demand Pest Control is prevented or delayed from performing by reason of any cause beyond its reasonable control, including without limitation: acts of God, hurricanes, tropical storms, floods, fires, earthquakes, pandemics, quarantine restrictions, government orders, strikes, embargoes, shortages of materials or labor, or similar events. On Demand Pest Control shall give the Purchaser reasonable notice of any such event and shall use commercially reasonable efforts to resume performance. Where performance is materially impacted for a sustained period, On Demand Pest Control reserves the right to adjust pricing or terminate this Agreement upon written notice.

12Change In Law

On Demand Pest Control performs its services in accordance with applicable law, including the Florida Structural Pest Control Act (Fla. Stat. Ch. 482) and the rules of the Florida Department of Agriculture and Consumer Services. In the event of a change in any applicable law, regulation, or licensing requirement that materially affects the cost or feasibility of the services contemplated by this Agreement, On Demand Pest Control reserves the right to (a) revise the applicable charges for any recurring services upon thirty (30) days written notice to the Purchaser, or (b) terminate this Agreement with respect to any service made unlawful or commercially impracticable by such change, without further liability.

13Non-Payment And Default

In the event of any non-payment or default by the Purchaser, On Demand Pest Control may, at its option: (a) suspend any further services under this Agreement until such default is cured; (b) terminate this Agreement upon written notice; and (c) pursue collection of any amounts owed. Past-due amounts shall bear interest at the lesser of one and one-half percent (1.5%) per month or the maximum rate permitted by Florida law. The Purchaser shall be responsible for all costs of collection, including reasonable attorneys' fees and arbitration or court costs, in any action by On Demand Pest Control to collect amounts owed under this Agreement.

14Payment Terms

The Purchaser authorizes On Demand Pest Control to charge the designated payment method (credit card, debit card, or ACH) for amounts due under this Agreement. Where a separate Credit Card Authorization form is provided, that form supplements (and does not replace) the authorization granted in this Agreement. Cancellation of autopay does not cancel the underlying service obligation, and the Purchaser remains responsible for all amounts due. If any payment is returned, rejected, or otherwise fails, the Purchaser is responsible for the full amount due plus any returned-payment or processing fees, and repeated failures may result in suspension or termination of this Agreement under Section 13.

15Disclaimer Of Other Warranties And Damages

EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH IN THIS AGREEMENT, ON DEMAND PEST CONTROL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. EXCEPT AS OTHERWISE PROHIBITED BY LAW, ON DEMAND PEST CONTROL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR LOSS-OF-ENJOYMENT DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES PERFORMED HEREUNDER, REGARDLESS OF THE THEORY OF LIABILITY.

16General Provisions

Entire Agreement. This Agreement, together with the Exclusion Form (where applicable) and any other documents incorporated by reference, constitutes the entire agreement between the parties and supersedes all prior oral or written representations, agreements, or understandings relating to the subject matter hereof. No modification or amendment shall be binding unless made in a writing signed by both parties. Severability. If any provision of this Agreement is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed; and the remaining provisions shall continue in full force and effect.
